RESOLUTION OF THE SOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO,
AUTHORIZING THE COUNTY MAINTENANCE OF THAT �

PART OF MIDLAND AVENUE DEDICATED BY REASON OF �
THE MIDLAND PARK SUBDIVISION j

WHEREAS, the Board of County Commissioners has, by its a
�
approval of the final plat of the Midland Park Subdivision, �
accepted the dedication, for public roadway purposes, of that �

part of Midland Avenue shown on said plat, and p
i;
WFIEREAS, the acceptance of the dedication did not, by ;i
�
itself, constitute acceptance of the maintenance responsibiliti:es` �
�
with respect'to this right-of-way inasmuch as acceptance was �
�
conditioned as follows: �
"The dedication of roads is accepted subject to �
the conditions that Pitkin County shall undertake x
maintenance of such roads only after construction �
of such roads has been completed in accordance �
. within (sic) Pitkin County specifications and �.
the Board of County Commissioners has by subsequent
Resolution agreed to undertake maintenance of the �
same.": :�
AND WSEREAS, the Board has been satisfied that the �

roadway has been constructed according to County specifications �

and wishes to agree to undertake maintenance of the same, -�

NOW, THEREFORE, BE IT RESOLVED by the Board of County �'
Commissioners of Pitkin County, Colorado, that it does hereby �`

agree to undertake the maintenance and repair of that part of ''

Midland Avenue dedicated to Pitkin County for public right-6f-
way purposes, all as described on the condominium map of the
Midland Park Subdivision of record in Book � at Page f�
of the records of the Pitkin County Clerk and Recorder.
