RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO

GRANTING SPECIAL REVIEW APPROVAL �
FOR THE PITKIN IRON MINE �

WHEREAS, the Pitkin Iron Mine (consisting of a mill site, �
haul road, quarry and transfer site), owned and operated by ;�•
i -
the Pitkin Iron Corporation, is defined as a high impact and
�
�
nonconforming use which, pursuant to Section 7.02(b) of the '�:
�
Pitkin County Land Use Code, must receive Special Review �
Approval for continued operation, and '
,
WHEREAS, Pitkin Iron has made application for Special � `
Review approval which application was reviewed by the Planning
�
and 2oninq Commission at its regular meeting held July 26, 1978,
and recommended for approval subject to certain conditions �
specified in the Commission's zesolution, and �
WHEREAS, after hearing on and review of the application �
the Board wishes to grant approval, subject to certain conditions �
hereinafter specified, �
NOW, THEREFORE, BE IT RESOLVED by the Board of County �
Commissioners of Pitkin County, Colorado, that it does hereby �
grant Special Review approval £or the operation of the Pitkin !�

Iron Mine subject to the following conditions and limitations: ��"•,

1. The applicant shall comply with any and all provisions '�
�, '
of its reclamation plan on file with the State o£ �t
Colorado Mined Land Reclamation Board.
2. In addition, within one year from the time that all i;
mining activities are terminated (as determined by the :;
Board of County Commissioners) the following actions shall �..`
be taken with respect to the haul road servicing the ;;
mine:
(a) The road shall be regraded, scarified, '
i
reseeded and water bars constructed within the
reclamation period specified in the applicant's
plan approved by the Colorado Mined Land Reclamation
Board.

(b) The road shall remain open to 4-wheel drive ; .

� vehicZes, only, up to (and for the purpose of �

maintaining) the Lindley Hut; and from this point �

-' and to approximately the 11,500 foot elevation �

rt, vehicles beyond this point.

� 3. There shall be prepared, and submitted for approval

� Prior to the annual hearing provided foz in paragraph
9, an engineered drainage plan establishing a self- � .
` � �maintaining drainage system operable on termina�ion
� of all mining activities.

� 4. All "fines" locate8 at the quarry site shall be
; removed within the reclamation period identified in
;
paragraph 2. •
5. The applicant shall begin periodic monitoring of
water quality in the area to detect changes in trends
in water pollution parameters. �
� 6. The applicant shall verify that there is sufficient �
distance and free board to insure that there can be no
washout around the mill site stockpiles.
7. The applicant shall (at the Woody Creek transfer
site) immediately remove from the river banks and �
trestle the accumulations of iron ore fines below the
conveyor belt across the Roaring Fork River; and

preventative measures shall be taken to eliminate �
a recurrence of these accumulations. �

8. All reclamation required by and described herein ! ,
shall be secured by that certificate of deposit
�
described in the Security Agreement between the applicant and �
Mined ' Land Reclamation Board executed for the purpose '
of providing surety for the permit issued to Pitkin Iron ;
by said Board. In the event that this surety shall not '
or cannot be made available for the benefit of Pitkin
County, the applicant shall supply to Pitkin County a
bond in amount and form (determined by the County Engineer)

reasonably calculated to insure performance of the require- �f '
ments hereof. �
_ ' 9. This special seview approval shall be for a period
o£ one yeaz only and this permit renewable annually at the
direction o£ the Board of County Commissioners subsequent
to public notice and hearing.
