SUBMITTING TO THE ELECTORATE A PROPOSED �
AMENDMENT TO THE METHOD OF DISTRIBUTING TAE COUNTY �

SALES TAX (2G) AMONG MUNICIPALITIES WZTHIN PITRIN COUNTY

�+ WHEREAS, at the time of adoption, this sales tax

�+ the Director of the Colorado Department of Revenue and should

�; be "distributed to the County o£ Pitkin and to the City of -

#� WHEREAS, since the establishment of this method of
;
distribution, two events have occurred making this arrangement ,
r,
�3 obsolete, namely the incorporation of the Town of Snowmass
0�
� Village and the establishment of commercial uses within ,
�i areas of the Town of Basalt lying within Pitkin County, and �`
� WAEREAS, the Board of County Commissioners have deter- �
�
„� mined that it is in the best interests of Pitkin County and
�' incorporated cities and towns (present and future) if some �
formula is adopted which will return some County sales tax �
�; revenues to all incorporated cities and towns within the �
County (in addition to the City of Aspen) as �aell as provide �
>r a nechanism for automatically providing for the same dis-
� �
�'s' tribution to new cities and towns within a stated period i
E� �� after their incorporation, and

WHEREAS, the Board and representatives of the City i
of Aspen, Town of Snowmass Village, and Town of Basalt have k
_
agree upon such a formula and the Board of County Commissioners � �
�
wish to submit the same for approval by the electorate,
NOW, THEREFORE, BE IT RESGL"JED by the Bvard of Cuun�y �
�
Commissioners of Pitkin County, Colorado, pursuant to the
provisions of CRS 1973, Section 29-2-101, et seq., and Section
7.2.11 of the Pitkin County Home Rule Charter, that there
be referred to the qualified electors of Pitkin County at -
the general election to be held on Tuesday, November 7, 1978,
the following question: �
Shall the existing provisions for the distribution
of the County sales tax (478 County/538 City of
Aspen) be repealed and, beginning January 1, 1979,
provide for a new method of distribution as follows: � '
(a) Pitkin County shall retain for its exclusive �
use 43� of all County sales tax revenues
collected within all incorporated and unin-
corporated areas of Pitkin County. �
(b) The remaining 578 of County sales tax
revenues shall be allocated among the in-
corporated cities and towns within Pitkin
County in proportion to the amount of County
sales tax collected within their respective ;
corporate li.mits. �
(c) The Board of County Commissioners shall, on �
or before November first of each year, `�
determine the share to be received by each X
such city and town, by averaging the amount �
of County sales tax revenues collected within �� '
the respective cities and towns within the r •x
preceeding two year period, as well as ;
examining the effects of any annexations or �
incorporations occurring within the year ;s
� period elapsing since the last determination ,
a was made. Any distribution formula thus
arrived at sha11 be final and effective on
the following January first. '
(d) As a condition for receiving their share of -
County wide sales taxes, incorporated cities
and towns within Pitkin County shall make any
� of their recreational programs available to
city/town and county residents on an equal
basis, as well as participate in the County
open space acquisition program and share in
the costs of owning and operating the sanitary
land fill site.
(e) With respect to any cities and towns that
may be incorporated in the future, they shall
share in County sales tax revenues in the same
manner as described in paragraph (b) beginning

: on January first of the year subsequent to
- the effective date of their incorporation.
(f) The Board of County Commissioners may, by
resolution, adopt any definitions or procedures
- concerning the assessment and collection of the
_ County sales tax that may be required to im-
plement this proposal in the best interest o£
the public.
