QF PITKIN COUNTY, COLORADO, GRANTING SPECIAL REVIEW �K35:7 �F 75� �
APPROVAL FOR SEPARATE OEVELOPMENT OF LOT 14, SLK. 3,
FILING 2 OF THE BRUSH CREEK VILLAGE SUBDIVISION

WHEREAS, Nans Lull is the record owner of Lots 14 and 15, 61ock 3,
_ Filing 2 of the Brush Creek Village 5ubdivision, and
WNEREAS, the owner has requested permission to separately develop�
Lot 14 of the Brush Creek Village Subdivision pursuant to the provisions of
Section 7.22 of the Pitkin County Land Use Code permitting the separate
development af substandard contiguous lots under single ownership upon
special review approval of the Board of County Corrdnissioners, and
WNEREAS, the Planning and Zoning Commission considered the request et
their regular meeting on August 23, 1978, at which time they recomnended
approval of the lot separation subject to a 6acter4ological and chemical
quality report being provided to the satisfaction of the County Sanitarian
and provided an engineered foundation is designed to mitigate the geoloic
hazard, and
WHERERS, the County sanitarian testified that Land Use Code Require-
ments with respect to water quality and to the septic tank absorption
system have been satisfied by the applicant, and
WNEREAS, the applicant has submitted an engineering report on the
foundation design prepared by Charles Collins, Gonsulting Engineer, which �
suggests two methods of mitigating the geologic hazard, and '
WHEREAS, the Board of County Commissioners has reviewed the recomnen-
' dation uf the Commission and the evidence and testimony oresented with re-
� spect to the application,

NOW;.TNEREFQRE BE TT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado, that it does hereby grant special review approval
i: .
for the seperate development of Lot 14, Slock 3, Filing 2 of the 8rush Creek j `
Subdivision, with the condition that the cutbank be reshaped and reduced �
in steepness te a 1:1 sTope and that revegetation and terracing be done
prior to any further construction or improvement on the property. �
