-T JOINT AGREEMENT �

THIS AGREEMENT made by and between the CITY OF ASPEN,
COLORADO, a Municipal Corporation and Home Rule City, created
pursuant to Article XX of the Colorado Constitution {hereinafter -
referred to as "City"), and the BOARD OF COUNTY COMMISSIONERS OF
PITKIN COUNTY, COLORADO (hereinafter referred to as "County") •
WITNESSETH:
WHERAS, there exists a need for improvement of communica-
�' tions service within both jurisdictions, and
WHEREAS, those parties involved in said communications
system are also the parties who provide emergency services to
�,.:
both jurisdictions, and

' ;?: WHEREAS, both parties desire to improve their emergency
communi�ations system;
� NOW, THEREFORE THE CITY AND COUNTY AGREE TO MAKE CERTAIN

AMENpMENTS AND ADDITIONS TO THE JOINT AGREEMENT SIGNED FEBRUARY 23, �

(1) It is hereby agreed and understood that with respect �
to the February 23, 1976, agreement, the Joint Communications and �;

Services Board (hereinafter called the "Board") is now comprised �
of the City Manager of the City of Aspen, the County Manager of
� ;.:i
Pitkin County, the Police Chief of the City of Aspen, and the
;s
Sheriff of Pitkin County. These members shaZl be responsible far ��
making general overall policy decisions which relate to the communi-
s�y .
cations center and to matters which relate to communications and ',-:i
;;;
e mergency services within the City of Aspen and the County of ,i
Pitkin.

(2) It is hereby agreed and understood between the parties

that the Board will be solely responsible for hiring and firing �,
�
the Communications Director.

, (3) It is hereby agreed and understood that the Communica- �
�` tions Center Director shall be solely responsible for hiring and �

;;;� firing Communications Center Personnel.

'� (4) It is hereby agzeed and understood between the parties �

�� that the Communications Center will be located withint the Aspen Police �

�� Department, which is located in City Aall at 130 South Galena, Aspen, ;*y

� Colorado, or until such time as the City Council and County Commiss- �:
M ��
� ioners deem it necessary to relooate the Communications Center �
.� facility.

� (5) It is hereby agreed and understood that the administra- €
� tive telephone lines £or both the Aspen Police Department and the

Pitkin County Sheriff's Office, to wit, 925-2025, 2026, 2027, 2028, and �
��
925-3232, 3234, 3236, shall be housed within the Communications �
Lw
Center. It is further agreed in this connection that only Police �
�
Department administratiVe lines will be answered by records or dispatch �
personnel on duty. In the event that emergency calls come in on t,
�; ��
administrative lines with respect to either. the Police Department or %
��
� Sheriff's Office� the dispatcher will handle only those that are ,s
i
emezgency calls. !j`
(6) It is hereby agreed and understood between the parties ? .

that the Communications Center shall origiaate all radio traffic
for which it is responsible with respect to law enforcement. However,

during a disaster oz emergency situation, the emergency operations `i
center (EOC) may designate authorized personnel to operate the R-1 ���
'.�
remote base with pezmission from the Communications Center. ��
(7) It is hereby agreed and understood between the parties
that the communications center shall house all records and master -
files for both the Aspen Police Department and the Pitkin Country `�
Sheriff's Office. In this connection, all jail and booking reaords
shall be maintained by the agency (Sheriff's Of£ice) housing the
jail facility. �'�

- (8) It is hereby agreed arid understood between the parties �
?r that the Board shall meet as required on the first Tuesday of each �
; month and shall be responsible for funneling grievances with respect �
`.�.` fo the communications center. It further is the intention of the �
'� Board to include radio services of all government facilities within �
K` the Council as it becomes feasible with respect to the needs of the �
± community and with respect to the monetary allocations needed thereto. �

�; (9) It is further understood and agreed by the parties that [�

�� the annual budget recomrnended by the Board and approved by both the .K^�

� City Council and the County Commissioners is assumed by both parties with �,

the City contributing 50 per cent of the total costs and the County j

h 50 per cent of the total costs. �
.� (10) This agreement shall become effective on the date of

i the signatures of all of .the parties hereto.
� (11) Either party hereto may terminate this contract by
;
� six months written notice to the other party, and it is agreed that �
� �
such termination will not affect the rights and interests acquired £
; �
' by the respective parties during the term of this agreement if such �
f interest has, in fact, been acquired. If such reimbursement is, in �

� fact, to be made, it shall be based on services performed and work �
� i

' ` (12) It is further agreed and understood between the parties �
that should said termination take lace ursuant to � �

11, the City and County shall split jointly owned capital equipment �
if there should be any, on an equitable basis according to the �
financial contribution of each. �
