This Memorandum of Understandin� by and between Pitkin County, State
- of Colorado hereinafteX called the "COUNTY" and the United States
Department of ARriculture, Forest Service, Rocky Ttountain Repion,
. hereinafter called the "FOREST S�RVICE," sets forth the responsibilities
of each party with respect to the development and operation of those
roads tliat are part of both the Forest Development and County road .

It is mutually recoRnized that:
, The COUNTY is vitally interested in providinR and operatinR a road system
• to provide adequate vehicular access for residents and cemmercial enter-
prises both for intra and inter-county travel, and
The FOREST SERVICE is vitally interested in providing and operatinR a :
road system for vehicular access that will intep,,rate with other trans- `
portatien systems and facilities and which provide access for the use
and enjoymenC of National Porest resources. Diany of ihese nlanned and
• existing roads, both adjoining and within the National Forests, will
. benefit and provide for the needs of the COUNTY and the FOREST SERVICE�

4. Environmental Analysis Report (EAR) .
The report of the evaluation of the effect of a proposed road �"�.
, improvement on the environment, its social and economic effects
- and on land uses. It also considers all feasible alternative
courses of action.
Yhase I EAF - evaluates feasibility of alternatives for project.
Phase II EAR - evaluates specific project, determining guide-
lines and criteria necessary to protect environment. ,
� 5. Forest System Road �
A road needed for protection, management and utilization of
• National Forest lands and resources and where designated a
� Forest Development Road by the Regional Forester.
. 6. Jurisdiction -
� The authority to control and regulate the use of a road
� , throu�h right-of way ownership or rights conveyed in the
easement or permit. Control here means the right to do work
� . as necessary for proper road operation. Control can be
shared by mutual agreement.
7. Law Enforcement
The act of policfng and citing violators of laws or regula-
tions.
� 8. 2laintenance
The act of preserving a road as nearly as possible in its • �

(b) Zn a continuing on-the-ground review of developing
• , design, prepare a Phase II EAR defining final project
requirements in concert with preparation of detailed
project p11ns by County.
(c) Issue a Special Use Permit authorizing occupancy of
National Forest lands for construction purposes.

� C. ROAD OPERATION
. � [ . . � . . . ..
' Management of road operation is necessary for the protection of � _
the public investment and environmental values, coordination of _ '
multiple-use activities, safety for all users and to reasonable .
access for all types of public traffic. Itoad operatzon includes
all activities dealing with maintenance, signing and control of
� road use. '
The variovs road operation responsibil3ties and'jurisdiction for
• each road on the joint system is itemized in Schedule A (attached
to and made part of this Memorandum of Understanding}, Schedule A
will be reviewed in the annual meeting, and modified as necessary. �.
State traffic codes apply to all roads under County jurisdiction. .
For those roads under Forest Service jurisdiction it must be so
� , stated in Schedule A that the roads are open to the public (un-
restricted). State traffic codes will -�pply.
' • The County is responsible for law enforcement and traffic accident
investigation on all public roads regardless of jurisdiction. The
Forest Service is responsible for enforcement of rules in addition
to or conflicting with State laws on roads designated as "restricted
use" in Schedule A. The responsible Agency is in no way committed
to a fixed policing and patrol schedule by this ATemorandum of
Understanding.
The Forest Service may close or regulate use on roads under its
jurisdiction. When in the public interest, the Forest Service may
redesignate public roads under its jurisdiction tts "restricted use"
to close the road or regulate use.
The Forest Service may designate any roads under its jurisdiction,
. "Special Ser.vice," for purposes of requiring users to share in the
costs of construction and maintenance. Y

The County and the PoresC Service will, within their authority, �
actively strive L•o contral vehicle weights below leRal or posted �
, limits.
The Forest Service and the County, whichever is assigned signing
responsibility on Schedule A, will undertake a program of providing
and maintainin� adequate sip,ns meeting current Manual on Uniform
Trafiic ContYol Devices Standards. The Agency assuming jurisdiction
. will erecC route markers, indicating the route number.
D. PAYMENT PROCEDUR�
: The Forest Service may negotiate with the County to maintain
additional Forest Development roads which are not a party of the
' joint system. The additional roads are listed in Schedule B
(attached to and made a part of this agreemenC).
E. CONCLUSION
1. This Tfemorandum may be amended or supplemented by mutual
acceptance by the signers or their successors. This
� Memorandum may be terminated by either the County or the
Forest Service throu�h 90-day advance written notice by
either party to the other. Schedule A may be modified at
any time by mutual written consent.
2. Nothing herein contained shall be construed to obli�ate the `
Forest Service or County beyond the extent of available funds _.
allocated or programmed for road development and operation,
' or contrary to applicable laws, rules and regulations.
3. Y�ere applicable, any contract, agreement or understanding
• ' entered into pursuant to this Piemorandum providing for work or
actions to be performed shall include the requirements of
' Federal laws, Executive Orders and Regulations and State
' Statutes.
• 4. It is understood that those roads solely part of the County
system, or those roads solely a part of the Forest Service
system, are not considered as part of this Tiemorandum.
5. A map showing the joint road system is attached and made
' part of this Memorandum. •
6. We have read the foregoing and agree to accept and abide by
the procedures herein:
