WHEREAS, Mr. Michael Oksner has made General Submission f

application for a Ywo 1ot subdivision generally located to the'north '

and ad3acent [o the Redstone Ranch Acres Subdivislon above Redstone, and �
WHEREAS, the tract of land consists of 23.73 ± acYes which
is proposed to be divided into two parcels; one of 14.46 acres and the
other at 9.26 acres, and
WHEREAS, the property is currently zoned R-6 P.U.D., Reaidential,
Planned Unit Development, and a generally zoning reconsideration is in
ptocess for the Crystal River Va11ey, and ,

WHEREAS, on October 13, .1976, the Pitkin County Planning and �

. Zoning Commission voted unanimously to recommend denial of the General ; !
Submission, having conducted a site inspection on October 6, 1476, and �.
the reasons for such negative recommendation are incorporated in the (

County Coffiissioness findings enumerated below, and

WHEREAS, on November 8� 1976, a public hearing was'held �:

before the Pitkin County Commissioners to consider the General Submission,
NOW THEREFORE BE IT RESOLVED, that the Pitkin County Com^
missioneYS herehy deny the General Suhmissian application for Oksner-Tob1n
`.•,: Subdivision for the following reasons:
��� 1. The C.S.U. maps show an alluvial fan and snow
avalanche area crossing the sites. The applicant f
!
has not demonstrated these areas not to be �
hazardous for building sites.

2. Sewage disposal areas would be in the alluvial fan and j
within 150 feet of the Crystal'River, and potentlally �
contributed to pollution of the Crystal River. '
i
3. The building sites a=e located so as to receive a �
!
minimal amount of sun exposure. Steep cliffs
severely shade the property. This is not in compliance �
with county policy of encouraging solar energy si.ting. �
�
4. Road access to the aites is a 20 foot easement through �
an existing subdivision. It has not been demonstrated }
�
that this easement will serve an additional subdivided �
lot nor is of sufficient design for safe use of the
road. The Land Use Code requires a minimum 30 foot
road access easement.
�
5. An adequate water supply has not been demonstrated. �
�
6. The lot sizes are deceptively large in that only a
few acres are useable for homesites. The rest is
isolated above an existing cliff.
