- . RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS PETITIONING THE CITY . � � .
- � COONCIL OF ASPEN� COLORADO TO DISCONNECT APPROXIMATELY 1.2 ACRES OF - � � `
COUNTY OWNED LAND ANp DOING SO PURSUANT TO SECTION 31-12-501, ET SEQ.
WHEIZEAS, the Hoard of County Corm�issioners is the owner of land
adjacent to the Aspen City limits commonly called the Midland Park Project
lands, an area pmposed for the development of a housing complex under
the P[�hI zoning category of the Pitkin County Land Use Code, and
WFIEREAS, approximately 1.2 acres of the project area lies
within•� the Aspen city limits, and
WT�REAS, the Hoard, as owners of the project lands, wishes
. to disconnect these 1.2 acres, inasmuch as
a. the development of the project as proposed
cannot.occur if subjEct. to city.zoning
code provisions applicable to the site;
b. the development of the project will be
great2y expedited if under the e�cclusive
. jurisdiction of the County rather than
requiring the duplication of processes for
subdivision, PUD and rezoning approval in �
each the City and County;
c. the housing project proposes a unified
street and utility system, the maintenance and
servicing oE which will be less cumbersome
under one jurisdiction; and
d. the area proposed to be disconnected has not
previously been platted into townsite lots, �.
been approved as a subdivision within the
city, nor been extensively serviced with city
� streets or utilities, all of which indicate
Ehat the area has not been integrated into
the city of Aspen making disconnection

appropriate; and
Wf�REAS, the procedures outlined in C.R.S. 1973, Section
31-12-501 (as amended) require that disconnection procedures may be ini-
tiated by application for disconnection being made to the governing
body o£ the city in which the subject lands lie, and the Boazd wishes
to so proceed,
