RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS I
OF PTTKIN COUNTX, COLORADO, GRANTING AN EXEMPTION
FROM TAE DEFINITION OF SUBDIVISION FOR THE CONVEYANCE
BY LINDA J. .HARLEM AND BROOKE A. PETERSON OF A.PART .OF
CERTAIN REAL PROPERTY LOCATED IN SAID PITKIN COUNTY, COLORADO

WHEREAS, Linda J. Harlem and Brooke A. Peterson are optionees
under a receipt and option contract for the Pollowing described real
property in Pitkin County, Colorado:
A tract of land situated in Lot 15, Section 9,
Township 9 South, Range 85 West of the Sixth `�
Principal Meridian described as follows:
Beginning at a point on the Southwesterly
line of County Road whence the South quarter
corner of said Section 9 bears South 39°41' East �

WHEREAS, they request an exemptior, from the deF�.nition of the
subdivision for the purpose of parceling the said property, and �
WHEREAS, Harlem and Peterson, upon the closing of their

contract with Robert Plum propose to convey a part of the afore- !

mentioned real property to Steven Pruden, and

WHEREAS, the proposed conveyance meets the reqairements
of Section 4.02.02 of the Pitkin County Land Use Code making the
grant of the requested exemption appropriate at this time,

NOW, THEREFORE, LET IT BE RESOLVED by the Board '
of County Commissioners o£ Pitkin County, Colorado, that there
be and hereby is granted to Linda J. Harlem and Brooke A. Peterson
an exemption from the definition of subdivision for the parcelling � �
i
and conveyance of a part of the aforementioned real property, i
which parcel to be conveyed shall be a piece of property of !
approximately one (1) acre in size to be more particularly described �.
by a survey to be recorded upon or prior to the sale by Harlem �
�
and Peterson to Pruden. �!

BE IT FURTHER RESOLVED that this exemption is conditioned I

: upon the conveyance of this parcel only to Pruden, for the benefit �

of his adjacent property, it being the intention of the Board �

that the conveyance to be made benefit the property of Pruden �;
only and not create a separate indentifiable parcel for develop- ;
