RESOLUTION OF THE BOARD OF COUNTY CONQKISSIONERS �
OF PITKIN COUN'CY, COLORADO, AMENDING CERTAIN PROVISIONS OF
THE ANSCHUTZ SPECIAL REVIEW USE PBRMIT AS APPROVED ORIGINALLY
., ON SEPTEMBER 22, 1975, BY PITKIN COUIYTY
Resolution Number 77-7�0 �
WHEREAS, the Board of County Commissioners of Pitkin County, Colorado,
has issued to the Anschutz Coal Corporation (hereinafter "Anschutz") a Special �
Review Permit for the operation of underground mining, and related activities,
at the Thompson Creek Coal Mine pursuant to the terms and conditions of the
Board's Resolution Number 75-65 adopted on September 22, 1975, and
MIk�REAS, such permit has been annually renewed, with amendments, more
particularly by resolutions of the Board dated May 10, 1976, and December 27,
1996, and

WHEREAS, the Board of County Commissioners, at its special meeting held
June 6, 1977, did again consider the outstanding permit and did agree to further
amend the same, all as hereinafter provided, �

NOW, THEREFORE, be it resolved by the Board of County Cwmnissioners of d
Pitkin County, Colorado that the Anschutz Special Review Use Permit approved
on September 22, 1975, be deemed renewed and effective until October Z, 1978,
subject to earlier termination according to the provisions thereof. �

BE IT FURTHER RESOLVED, that the mine discharge irrigation diversion pro- �-
ject required by paragraph 8 of Resolution Number 76-48 shall, the provisions �'
of said Resolution Number 76-48 to the contrary notwithstanding, be constructed �
according to the following schedule: �
. a. That those improvement described as Phase I in that document �
entit2ed "Anschutz Coal Corporation Mine Discharge Irrigation ;
Diversion Project" attached hereto as @xhibit A and incorporated �

by this reference and further illustrated in that site plan �{.
�
attached as Exhibit B hereto, shall be constructed prior to
December 31, 1977; and �

b. Further that the balance of the improvements necessary for
the completion of the mine discharge irrigation diversion
project shall be completed on or before December 31, 1978.
� BE IT FINALLY RESOLVED that for the purposes o£ determining compliance
with the provisions of the Special Review Use Permit those water quality
standards in effect on December 13, 1976 shall remain in effect until the
completion of the mine discharge irrigation diversion project, the pro- ,
visions of paragraph 2 of Resolution Number 76-163 to the contrary not-
withstanding.

The total irrigation syetem, cahen completed, will include an irrigation �

reaervoir, eeveral miles of pipe, valves, pumps, controls and a mine aite surge ;
reserooir. The first phase of this project wi1Z be at the mine site itaelf. It �

'� will involve laying of pipe, installing controls £or proper flaw, preasure and , i
coordination with existing consumptive uaes of the mine water. it will also include �.
modification of the present sewage system and resulting creation of the projecte �

surge reaervoir. All details of Phase I are being pursued at this time from elec-

� trical plaaaing through Colorado State Department of Health apprwal of discharge � .

zin both of the enclosed drawings. Approximately 10 to 15 valvea and tie-in water

� lines have been omitted from these drawings for a more simplistic preeentation of j�
� Phase I. This ia mentioned only to illustrate the complexity of this system.
While Yhase I is only the firat step of the total irrigation project, it ia atill

� a functional step. Extra water linea will be installed immediately under Phase I,
jat the point where the total project will continue later. This will allow irrigat-
iion of mine eite revegetation done during the Fall of 1976 and [he Spring of I977.
