OTHER CONDITIONS OR SERVICES
Construction Management Services as described in the attached Owner-Construction
Mlanager Agreement, dated August 10, 1977, M77-21 C/M--are in addition to Professional.
Service described in this Agreement. The services described in Article I of the
Construction Management Agreement are in some instances an extension of the Architec-
tual/Engineering service described in the Owner-Architect Agreement M77-21. '.
>i
Therefore, fees have been computed for full service under the Owner-Architect :E
Agreement (77-21) and Construction Management fees have been reduced to avoid
any duylication of fees or services. It is understood that the fee for Basic '
Service for Architectural,Engineering and Construction htanagement will not exceed i1
I8'k of the total construction cost of the project; however, unknown conditions in
a remodeling project may justify an upward adjustment of this top-set amount. '`
Any request for such an adjustment must be made in writing, stating the condition and
estimating the amount required. Written authorization by the Owner to exceed the
top-set 18 must be secured prior to continuing the service of tlie Architect, .
Engineer or Construction hlanager. °`
Ilowever, Agreement If77-21 and Agreement #77-Z1 C/M constitute a single agreement, ?'
and are to be executed'simultaneotisly. ''s
It is tmderstood by all the parties that completion of the services herein :
contracted for is conditioned upon receipt of EDA grant fimds, an application ':
for which is pending, in the event fimds are not awarded, Pitkin Coim ty may '"
terminate this Agreement without penalty; provided, however, that Benedict `:`
Associates Incorporated shall be reimbursed for time and cost to time of termination
at the rates herein specified. r
