OF PITKIN COUNTY, COLORADO �

, INDICATING THE INTENT OF THE COUNTY TO �
PURCHASE THE NORTH STAR RANCH i
FROM THE NATURE CONSERVANCY ,i

47EiEREAS, the County has been advised that The Nature i
Conservancy holds an option-to-purchase a substantial
part of the North Star Ranch, and �
WHEREAS, the County desires to purchase said Ranch I
from The Nature Conservancp to be utilized by the County �
as a wiZdlife area and for passive recreational uses, and �,
�
�
WHEREAS, it is understood that the purchase price to
the County shall include all direct costs incurred by
The Conservancy in the acquisition of the property including,
in addition to the land cost, the costs of title insurance,
recording fees, attorney's fees and other related expenses
of the Conservancy that result from the financing and
handling of the purchase, together,with the carrying costs
of the outstandinq balances of all advances to the project,
and �
WHEREAS, it is also understood that the County will �
be charged four percent of .the land cost to compensate �
for The Conservancy's overhead on the project, and
�
' WHEREAS, in tlie event that the County is unable to �
$
purchase the property from The Conservancy within the �
hereafter stated period, then it is mutually understood that g
� The Conservancy may take such further action as necessary �
to recover its investment. This may include placing the �
property for sale on the open market if no suitable con-
servation purchasers can be £ound, and
WHEREAS, it is further understood The Conservancy
will require, by deed restriction or otherwise, that the

County elect and maintain a permanent plaque or other J

appropriate marker, at a prominent location on the property, !
I
that bears the statement: "This area was acquired with
the assistance of The Nature Conservancy",
THEREFORE, BE IT RESOLVED by the Board of County
' Commissioners of Pitkin County, Colorado, that it does
hereby request The Nature Conservancy to acquire for ''`�
/7N.g
Pitkin County, 3�8 acres known as North Star Ranch, from
James Hopkins Smith.
BE IT FURTHER RESOLVED THAT Pitkin County will make
every effort to repurchase the property known as North
Star Ranch from The Nature Conservancy within three years
with monies to be made available from the County General
Fund in the event federal matching funds are unavailable.
