WHEREAS, application has been made by the Aspen �

Metropolitan and Aspen Sanitation Districts for an exemption ;� .
from the definition of subdivision under the provisions of `'

Section 4.02.02a.4 of the Pitkin County Land Use Code for �

the purpose of acquiring approximately 55.51 acres of the ��

':: -W/J Ranch, which acreage is presently used by the applicants �

; as a sludge treatment site pursuant to speciaZ review approval :�

t given by the Board of County Commissioners on November 18, `�

1974, and �

WHEREAS, the Board has reviewed the request and has t�

determined that the proposed subdivision is designed to create �

a separate parcel for the establishment of a community £acility ��
�
and that the grant cf an exemption from the definition o£ �;�-'
subdivision is appropriate, �

NOW, THEREFORE, BE IT RESOLVED by the Board of County �
� .
Commissioners o£ Pitkin Coun�y, Colorado, that it does hereby �
qrant an exemption froca the definition of subdivision to �
Aspen Sanitation District, Aspen Dietropolitan Sanitation �
District, and the owner of the L7/J Ranch for the purpose o£ �
�
parcelling and conveying 55.51 acres of the ranch (presently �
s
a
used as a sludge treatment) to the sanitation distzicts for �
the continued operation of the sludge treatment site, �
BE IT FURTHER RESOLVED that this exemption is conditioned
upon:
A. Continued compliance with the terms of Resolution
_ No. 74-95 including the following requirements and conditions:
1. Installation of reasonable soil, groundwater,

treatment site (and accessory structures) or similar use; �

' facility and it shall not, without subdivision review, be �

further subdivided nor be put to a use other than a community � -

facility, all as required by Section 4.02.02 a.4. of the Pitkin �`
County Land Use Code. �
