' RESOLUTION NO. ��-131 _
WHEREAS, Pitkin County Aousing Authority, Pitkin County, '
:
Colorado, (the "AUthority"} is a duly constituted body corporate +
of the State oE Colorado, its Certificate of Incorporation ; •
- having been filed with the Secretary of State of Colorado on �
March 7, 1975; and �
�
. WHEREAS, the Authority has title to the real property !
i
hereinafter described, commonly known as the Randall property, � �
on which it proposes to construct and equip low and middle �
income housing (the "Project"); and � 9
#
a
WHEREAS, it is necessary that interim financing be q
x
obtained i» order to start construction of the Project prior �
to the issvance of revenue bonds or similar securities of a
more permanent nature; and
WHEREAS, the Board of Commissioners of the Authority �
(the "Board") did this date adopt Resolution No. 77-132 �
authorizing a loan and advance from Central Bank of Denver, � .
a Banking Corporation, in Denver, Co2orado, and that the �
Randall property is to be encumbered as security for suah �
advance: �

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY �
COMAlISSIONERS OF PITKIN COUNTY, STATE OF COLORADO: j

Section 1. That the Board is hereby aufihorized to '
� �
encumber the property described in Section 2 as security for �
any loan or advance pursuant to Resolution No. ��'132 of ;

the Pitkin County Housing Authority. 's

Section 2. That the real property owned by the Authority �
� . and which may be encumbered is described as follows: ' �

MASCOTTE LODE MINING CLAIM, United States ;
Mineral Survey No. 5867, according to the �
United States Patent therefor recozded in �
Book 175 at Page 170; and �
"99" LODE MINTNG CLAIM, United States �
Mineral Survey No. 6899. according to the �
United States Patent therefor recorded in �.
Book 39 at Page 78;

and the lending institution, provided, however, that if a s

mortgage or deed of trust vests in a trustee the right, upon :`<.

the happening of an event of default, to foreclose such mortgage �
or deed of trust through judicial proceedings or through the {
exercise of a power of sale without judicial proceedings, consent �
to foreclose said mortgage or deed of trust is hereby given by �

the Board of County Commissioners of the County of Pitkin, �
State of Colorado. �

Section 4. That the Board of County Commissioners does �
agree to
hereby/make an appropriation of funds that will be sufficient ;

•when, taken together with the $2,300,000 borrowed by the Pitkin �
' County Housing Authority, to complete. the construction of the i
Midland Park Housing Project under the present plans and k

specifications. Because the $2,300,000 is in excess of the �

bonded construction costs of said Project the exact amount of :

this appropriation is unknown at this time and this �os a con- a

tingent appropriation of whatever moneys may be necessary to t

complete the construction of the Housing Units so that they �
may be sold or rented to produce revenues to pay the Revenue �
