JOINT STATEMENT OF PITRIN COUNTY� COLORADO, THE CITY OF ASPEN, COLORADO, THE STATE OF � COLORADO AND THE UNITED STATES FOREST SERVICE f CONCERNING THE LITTLE ANNIE SKI AREA ,i ISSUED PURSUANT TO STEP THREE OF THE � COLORADO REVIEW PROCESS .� 77• 15(, � RECITALS � � i ;, WF3EREAS, there has been proposed for development � within the City of Aspen ("City") and Pitkin County ("COUnty") � � � a new ski area name8 "Little Annie's", development permission for which will be required from each the City, County, � United States Forest Service ("U.S.F.S.") and State of � ; z i Colorado ("State"), according to their various laws, rules, � l regulations and administrative directives, and ; WHEREAS, the U.S.F.S. has, by a previously executed contract with the County, agreed that applications for the proposed new ski areas within the White River National Forest must proceed according to the Colorado Review Process, and � - WHEREAS, the City and State have a similar interest in � " participating in the Colorado Review Process inasmuch as the � purpose of the Process is to coordinate the actions o£ all � governmental agencies required to review any ski area proposal, j and �. � WHEREAS, the proponent of LittZe Annie's has submitted i an initial proposal for the project; this proposal has been f#. circulated among the af£ected governmental agencies; the =� :� r� proposal has been determined as one appropriately processed �,�� �5- under the Colorado Review Process; and representatives of 'k }. { all affected agencies have met and determined the criteria .3 4� to be used in intial].y evaluating the proposal and itemized � their concerns about the project, as well as having identified � ' a lead agency (interim) , so as to be prepared to issue that � ?� ��. .; �{ �! ;� :� •,.:,�� ;.. �;;tr' _ r, - �,1 r y: ' t. M. .. . ._. .. . _ �� y�. _ _ . .:��_ .. ���t . . • r�. , : . • +"�!� - 2 - Joint Statement called for in step three of the Colorado ;i Review Process; JOINT STATEMENT - NOW, THEREFORE, in satisfaction of the p�ocedural � ' requirements of the Colorado Review Process, the undersigned ; cooperating agencies state as follows: � 1. There is sufficient agreement among the affected j , local and state governmental agencies to initiate the pro- � , cedure for joint review established by the Colorado Review � I Process; provided, however, that nothing herein shall be � construed as a conceptual approval or other endorsement of � the pTOject at this time. � I 2. For the purposes of accomplishing those studies, i accumulating that information, and undertaking those .commun- � ication responsibilities necessitated by ihe Colorado Review I Process, the City/County Planning Office will act as lead agency from the effective date of this Statement until the public hearing required in step 7 of the Process, or until such other time as the parties shall agree. � 1 . 3. Prior to the execution by any party hereto of a i site specific cooperative agreement, as that agreement is i described and provided for in step 9 of the Process, each , 1 of the followi.ng inquiries shall be addressed with in£ormation � supplied to the lead agency (by the person or agency designated) � � on or before April l, 1978: � (a) Is the proposed location the appropriate available 4; �� site to be developed (within the area of influence) � to help meet most recreation demand needs? It is ' agreed that sufficient data exists concerning the � i7 physical characteristics of the site but additional � information on the social and economic impacts of � � the proposed development is needed to answer this question. The Forest Service, with an economic analysis to be supplied by the proponent, will make this determination. (c) Is the development compatible wit:h National Forest objectives? The Forest Service will make ' this determination. (d) Is there private land involved which is integral to Forest Service land in order to insure reasonable development of the site? The Forest Service will make this determination. (e) Is this the proper time for further study, and - (potential) development of this site? All participants will comment with respect to this guestion. (f) What time frame must be established to allow for + proper coordination of the planning and financing of ` the development and state and local planning needs I i (considering the time and manpower needed to update local and/or state plans, procedures and facilities a to adequately deal with the proposed development)? The Forest Service will r.take this determination. 4. The response to the question raised in Paragra�h 3(a) shall include an analysis of each of the following inquiries: • !�) Is there a need for additional skiing capacity in the � , .• S�'�=�i� P_s�en skiing cor�pler_; and, if so,when should it be supplied ��� and what indicators will demonstrate this need? (b) Which governmental entities will be directly and/or i indirectly affected by the develonment, and how? (Con- i , � sider the social, economic, and environmental effects � on local; regional, state and federal governments and ! i ; ::,ubi��s�. , y '- ',c) If the site were 8evelooed, would it be conaatible � -.:ith current state and local land use and growth plans? I i � {d) Do the local and state qovernments affected have � • � :;ocio-economic goals which the development would hela � � § s�eet? If not, is it necessary that such goals ba estab- � lished before the designation of the site? � (e) What would be the effect on local cor.�unities and i � � �xisting infrastructure (includinq transgortation, school, � I � ' utility and wastedisposal systems, housing and job o��or- � j tunities)? ' I {f) Do the State, City and County believe that existing � � � � NI � � }lans and procedures are canable of assimilating tne � effects of the proposed developnent? In addition, it is acknowledged that the City/COUnty ' Planning Office has conditioned its acceptance af the respon- `� f� sibilities of acting as lead agency upon being jointly funded � . by each the City of Aspen and Pitkin County and has requested � i t.; � (and received tentative a roval of) an a ; pp ppropriation of ten �, �4 � thousand dollars for 1478 to this end. In the event that either the City or County governments shall fail to make such ' an appropriation, the City/County Planning Of£ice reserves the right to withdraw its participation as the lead agency for the review herein called for. � j. 9. The Proponent shall, within thirty days after the effective date of this agreement, notify the lead agency as � to whether, giventhe contents o£ this Joint Statement, he � � wishes to proceed with, modify, or withdraw his proposal. _ 10. The Joint Statement is issued with the understanding �s, that the proponent has agreed to asswne all risks involved �: g. in proceeding under the Colorado Review Process and in the �' '� eveizt that if, at any time, the consideration of the proposal. .� is postponed or the proposal is denied, the proponent has �} agreed to waive any and all challenqe to such action and any r7 and all claims against the undersigned by reason thereoE, u F " 21.
