SIOWERS OF PITKIN COUfVTY, COLORADO. � i WI7NESSE7N : � WHEREAS, the incorp�ration of Snovnnass Village has created a need for i i ; research and plannin9 for that Town, and � YlHERE/15, the Town, the City, and the County all recognize that it is � dysfunctional to restrict such research and planning to jurisdictional 7ines i 1 - and that a mutual governmental planning effort wiTT facilitate clear commun- } ication and efficient planning productivity and that duplication of such � �) services by the Town, the City, and the County could only result in costly jl i • duplication of efforts, and I . i WHEREAS, it is the desire of all parties to share in the management and. expense of the joint planning office, pursuant to the statutory authorization concerning intergovernmental contracts, Section 29-1-203, C.R.S., 1973 and Section 13.5 uf Aspen Home Rule Charter. ! NOW, THEREFORE, THE TOWt�f OF SfdOIdMASS VILIAGE, THE CITY OF ASPEtd, AND PITKIN COUP�TY agree as follows: � A. Planning Office Responsibilities 1. That the Planning Office shall be responsible for: a. Research, includinc� the maintenance and updating of the � _ existing data bank, library, 7and use and housinq inventory. •� i population data, etc. for Snowmass Village. The Planning I � Office shall provide a copy of all data gathered for the � f Town's use at the To�yn's expense. b. The administration of the zoning ordinance and the subdi- � � � i Vision regulations of Snowmass Village. "Administration" � � ' here shall mean the preparation and presentation of recom- � mendations on various public and private land use proposals � or applications as well as re-evaluating and recommending a � suggested changes to the Town Planning and Zonin9 Commission and Town Trustees. Administration shall be distinguished r ' from Code enforcement, which is the responsibility of the � Town Building Inspector. � ; � d. Advising the Planning and Zoning Comnission of Snowmass � � Village. This advice shall serve as a technical support � � function with the understanding that the Planning Office ( � � � reserves the right to advise the Town Trustees of Snowmass � � Village separately and apart from the recommendations of � � the Planning and Zoning Commission. � � i � e. The administration of 5tate and Federal planning assistance i � � s and land use funds as may become available from time to time. i � I P. Communication between the Tovm of Snowmass Village, the City � . ' of Aspen, and Pitkin County on matters of physical develop- � ment which are of concern to all parties, as well as such � other responsibilities as may be assigned from time to time by the appropriate Board, including the organization of joint meetings for discussion and review of other matters of mutual concern. ' � � 2. That, in regard to Snowmass Village, the Planning Office shall i not be responsible for: � I a. Decision making, which shall be the responsibility of elected j officials. b.. Implementation and construction, wfiich shall be the respon- sibility of the To�an Mana9er, or in the absence of a Town Planager, the Town Trustees. The Director of the joint Planning Office, who is solely respon- � �i sible for the personnel affairs of the Planning Office, shall � _ appoint a staff inember to assume the responsibilities described � above in this agreement. Said staff inember shall continue to ; perform other duties for the City of Aspen and Pitkin County. � 2. The Director of the joint Planning Office shall have responsi- bility and authority for management di the budget and resources '� of the Planning Office. ; C. Planninq Offiice Priorities 1. The staff inember appointed to assume the responsibilities for � Snowmass Village shall devote 25 hours a week toward completion � of projects for Aspen and Pitkin County. Aspen and Pitkin County I shall be billed for no more than 1820 hours for said staff inem- I ber .(a weekly average of 35 hours) or an equivalent nur�ber � of hours for the term of the contract if terminated, unless this contract is amended to the satisfaction of all parties. � 2. Insofar as said staff inember'S commitment to completion of pro- jects for 5noamiass Village exceeds the balance of the h0 hour work week,compensation. shall be at the same hourly rate established herein, with no consideration being given for an , overtime rate. 3. Said staff inember shall certify as to the distribution of office time between work for Snowmass Village, Aspen and Pitkin County � by submitting bi-weekly time sheets. Program numbers established for all Sno�nnass Village work shall be retained by the City of ; ; Aspen Finance Department in the computer. Snowmass 4illage � shall be billed on an hourly basis as established herein. Information on work performed shall be surtenarized by program in , monthly reports submitted by the lrth of each month to the Snow- ( mass Village Town Trustees. _ 3 _ � . ; . The Town of Snovnnass Village may desire to establish funding , for programs requested by the Town Planner wiiich require Che utilizatiun of consultants or Planning Office Staff. Therefore � � the Town of Snowmass Village reserves the power�to communicate ! • i through the Planning and Zoning Commission and Town Trustees j � _ any change of the planning budget, work program, and priorities. " The Town Planner shall serve at tfie pleasure of the Town of Snowmass Village. . D. Planning Office E3udget i. The Toam of Snowmass Village approves the following budget and revenue commitment for calendar year 1979: F ij ITEM �� HOURLY RATE (� , t � Salary, Planning Staff Member $12.50 � In-Nouse Administrative Overhead at 10% 1.25 � � Insurance Programs at 2� ' ,25 FICA and Workman's Comp. Programs at 6% .75 : Retirement Program at 3% .38 j Nourly Rate Including Fringe Benefits: $15.13 ! �. Total salary for said Staff Planner shat7 not exceed $16,250 plus , fringe 6enefits, as outlined above, for the contract year 1979. i: If said Planner is unable to meet the average 25 hour weekly coimnitment to Aspen/Pitkin work, then it wi11 be neces5ary to renegotiate that portion of this agreement to the satisfaction of i: " all parties. It is further understood that time in transit to and from Snowmass Village shall be bil3�ed at the hourly rate only in those cases which require said Planner to spend less than a . full eight-hour day at Snowmass Village. � 2. The following items are not included in the estimated hourly rate � and shall be billed separately: � - -- Transportation costs at $.18/mi7e I -- Secretarial service at the secretary's salaried rate (approximately $6.00/hr., including 15� fringe benefits) i -- Xerox copying at .02/copy � -- Substantia7 acquisition costs (major supplies and equipment purchases, on the authorization of the Town.� � -- Printing and publishing costs, oniy upon authorization of j the Town if in excess of $25.00. � Snowmass Village at its option, may determine that it is advantageous � � , a - 4 - �. � : d �� _ , ;; . � ,.,..._ _._.._._ ,,...... _.. 1„ �. _._. A budget of $800 is established for educational and business j travel. Monies in this fund may be utilized only on a 50% ' f matching basis jointly funded by the City and County or by i - � the Town Planner, unless the Town authorizes otherwise. E. Accounting, Reports and Audit i A11 accounting, payroll and audit services for the joint Planning � Office shall be performed by the Finance Department of the City of ( Aspen. The cost of providing such services for the Town of Snowmass � Village shall be borne by Snowmass Village as described herein. � F. Renewal and Termination I ` 1. This agreement may be amended, revised, and readopted at the time i � , � of the official adoption of the budgets of the Town, the City, � - and the County. If not amended, revised, and readopted, said t � agreement shall lapse and be terminated at the end of calendar �i i year 1979. � ! 2. This agreement may be terminated upon thirty days' written notice . � � by either party to the other.
