12 day of March , 1979, by and between the BOARD OF
COUNTY COMMISSIONERS of Pitkin County, Colorado (hereinafter
` referred to as "County") and HOLY CROSS ELECTRIC ASSOCIATION,
Glenwood Springs, Colorado (hereinafter referred to as "Holy

inafter referred to as "Aspen Metro") :

WHEREAS, the County and Holy Cross entered into a 9
� Revocable Easement, dated September 18, 1969, and recorded r
!1 in Book 247 at Page 222 of the records for Pitkin County, ;;
a Colorado, for the benefit of installing overhead power lines �

`r,:! to serve the Aspen Metropolitan Sanitation District sewage

{ treatment plant.

� AND, W?iEREAS, the parties are desirous of amending said �
� Revocable Easement by creating a perpetual easement to Holy �

Cross for the benefit of the Aspen lietropolitan Sanitation q
� District. i '

� ' NOta, THEREFORE; for good and valuable consideration, the �
� easenent, dated September 18, 1969, and recorded in Book 247 �

� at Page 222 of the records for Pitkin County, Colorado, is �

�y hereby amended by deleting from said easement all of Paragraph �
�; i
� 2 of said easement; PROVIDED, AO'.OEVER, that in the event the � `
�� k
�_. County determines that the existing electric line easement �
�,� a
� interferes with its reasonable use of the railroad right-of-way, �
k
g it may require location of said electric lines and poles within '�
� 4
the County - railroad right-of-caay, which cost of relocation shall
�
be borne by the Aspen Metro, and that all other terms and conditions �
I �contained therein shaZl remain in full force and ef£ect.
This Agreement shall inure to and be binding upon the (
� : •�arties, their successors and assigns. �
