There is a need to plan now for additional skiing since existing facilities ate nearing saturation. � , 2. Responding to skier demand is essential to maintain the - economic viability of Aspen'as a quality ski resort area. � 3. Subject [o the consent of the other agencies involved and compliance with the preceding steps in the Joint Review Process, Pitkin County shall, within thirty (30) days from , j the date of adoption hereof, enter into a Site-Specific � Agreement to provide for additional studies of Little Annie, including the draft Environmental Impact Statement, to � determine whether or not final approval should be given. 5. Subject to the cooperation of the other agencies invloved; ; Pitkin County shall take all appropriate action to expedite _ the processing of [he Little Annie application through the � Joint Review Process". The city, by resolution, has determined that there may be a need for � , additional ski capacity in the Aspen area to provide a skiing experience � for local residents and that the Little Annie Ski Area may be an appro- ; - • priate site for development. The state has.approved the concept of a new ski area development within the Aspen/Snowmass area, and will support it if approved by the city and county; in addition, that it is appropriate to go to the site specific - stage of the Colorado Review Process but "that the study also include ` an analysis of the i.mpacts of an expansion at Snowmass". � i The Forest Service response was contained in correspondence from Tom � Bell in a letter dated Septe�ber 18, 1978, in which he said � � 1. "All econimic information I have reviewed to date has been of j a general nature and i find nothing at this point which would � j indicate the project should not be recommended For site specific � study. However, it should be understood that this circumstance may change due to any aew information coming to light as a result of mitigating measures which may be needed in more detailed site � _ specific study." t 2. "The development would not�conflict with National Forest objectives." � � 3. "The proponent has stated that he controls approximately 476 acres � which is integral to Forest Service land to insure reasonalbe � j - development of the site." � � • 4. "I believe this is the proper time for further study in order to I help provide future guidance for winter sports development in the Aspen area. 5. "I feel 18 months from the date the site specific study is . 1 authorized is an adequate amount of time for proper coordination . � of planning and financing." 6. "L have found nothing at this point which leads me to believe that private cap3tal cannot be induced to invest.in the project." ROLES The U.S. Forest Service is responsible for the administration of the National Forests and the policies and plans for the use thereof. The state of Colorado has jurisdiction over the health, safety and welfare of persons within the state and certain specific responsi- bilities, such as the enforcement of air and water quality standards and the protection of wildlife and preservation of its habitat. . Pitkin County/City of Aspen have the jurisdiction over health, safety, and welfare of persons within the boundaries of the County/City, and specifically, the authority for the planned and orderly use of private ' and other non-federal land and for regulating the use of land on the � , basis of the impact thereof on the County/City. ' ; The Proponent and the other parties to this Agreement, are responsible j for providing information about the proposal necessary to properly ' ; evaluate it, to show that potential adverse effects will be mitigated to acceptable standards, to meet the criteria and standards furnished 3 t + by the other parties and to show how the work will be performed in �- accordance with approved plans. � i i : � � V. II�LEMENTATION . In satisfaction o€ the.procedural requirements of Step 9 of the Colorado Review Process, all parties agree to £urther study the Little Annie Ski _ � ' Area pursuant to said review process and agree to cooperate in the ' following manner: A. The Forest Service will: 1. Combine the information of all parties and other groups and individuals, both public and private, into an Environmental ' Statement which shall address, at a minimum, all issues, concerns and relat'ed matters identified in both Appendix B and C attached hereto. Said Statement will be prepared, published and distributed in the manner and format prescribed in Forest Service Handbook 1909.15 (NEPA Process Handbook) and will satisfy: (a) All requirements under the National Environmental Policy Act of 1969 and guidelines promulgated pursuant i to the Act; and � (b) All quidelines for reports and statements established ' ' by the Council on Environmental Quality; and - j _ _ (c) The requirements of steps 9 through 11 of the Colorado ` , Review Process; and . ? (d) The Impact Analysis Guidelines "Illustrative Outline ' of Information to be Submitted for Review, Part 4", Winter � Resource Management Plan: Manual for Use of the Colorado I Review Process and Impact Analysis Guidelines, August, 1976, Department of Local Affairs, Colorado Division of Planning; ' and � (e) Sections 2 and 5 of the Pitkin County Land Use Gode , entitled "Policies" and "General Regulations". - Said Statement will be completed within approximately 18 months (but not to exceed 24 months) from the effective date of this Agreement. ' ( � � ' S ) 2. In lieu of the .appointmeat of an Ad Hoc Citizens Comm3ttee � ireferenced in Step 8 of.the Colorado Review Process, the Forest i � .. Service further agrees that it will solicit coa�ent and reco�en- dations from the Aspen/Pitk3n County citizenry and the public at I large, as required by the NEPA Process, to assist in the enviroa- i _ � mental assessment. The solicitation of such participation by the , i � Foreab Service shall consist in, at a minimum, the issuance of a t press release by the Forest Service to the Aspen Times, Glenwood � Post, KSNO, KSPN giving notice of the opportunity to submit I. written co�ent and granting of at least a 60 (sixty) day . period in which to do so. Serve as the lead agency, being represented in this capacity by the City/County Planning Office. The County shall continue as lead agency under the Review Process vntil it shall withdraw or be relieved by amendment hereof. In the event the County shall cease to act as the lead agency, the Forest Service shall assume that role. In addition to other responsibilities assigned to by the Colorado Review Process and this Agreement, the lead agency - agrees to: (a) Provide interested citizen gronps an opportunity to � submit to the lead agency names and addresses to which the lead agency shall send notice when consultant studies are - - - received; and notice of when the parCies to this agzeement ; ,! intend to meet for the purpose of discussing this agreement ! or progress under its provisions; and ; i (b) Provide, within 30 days of any request by any party to this agreement, copies of any official co�ents received i � by the lead agency pursuant to this agreement. , ! (c) Process the required application for Special Review Approval (for both Special Review Use and H.B. 1041 Reviews) ; submitted pursuant to Section 6 of .the Land Use Code and processed under the relevant provisions of Sectian 5. Inasmuch as it is the desire of both the,proponent and county that the county's review'of=the'.Specia! Review Application constitute,substantially, the county's � input to the Environmental Statement, these parties ' � agree to establish a schedule for processing the app- ' lica'tion in such a manner that the specifics of the � : � application and the broader issues identified in this � Agreement may be addressed, simultaneously. -, j It is understood by the parties that denial of any of the i � petmits and/or approvals above described will not absolve ; any party from undertaking or eompleting anq of its res- � ponsibilities uader this agreemeat; provided, however, that •� the proponent may withdraw its application at any time at I � which point all parties would be released from their obliga- � tions gursuant hereto. � (d) Jointly;.with the proponent, recruit and htre the . � � consultant(s). A11 consultant(s) cost are to be paid through the lead agency. ; {f) Along with the city of Aspen, contribute its share . oE $15,000 to be applied to the hiring of consultants to the study of those.inquiries so referenced in Appendi.x i C attached hereto. i In the event that the $15,000 allocated by the city and � county is not sufficient to complete these studies, the I proponent shall be obligated to contribute one-half of all such additional amounts as may be expended by the j ` city and county to complete these studies. Further, the parties recognize that the proponent for the pending ' BurnC Mountain (East Village) application should also contribute to the study of these questions and, accord- , ingly, if and when the Burnt Mountain appl3cation becomes the subject of a site specific agreement, it� should be obliged to the extent the city and county are able to zequire it to do so to pay (or reimburse) all such addifional amounts that would otherwise be paid by the city and county hereunder. i � � D. FOREST SERVICE ASSURANCES � The Forest Service assures the other parties to this agreemeat that: t ' I, The U.S. Forest Service Multiple Use ManagemenL Plan, Aspen District for the White River National Forest allocates the proposed I.ittle Annie Ski Area as a Winter Sports Study Site; and � 2. The proposed Little Annie Ski Area has not been reco�nended ifor wilderness in the RARE II Final Enviro�ental Statement. I . � VII. AMENDMEr]TS I i Any change or amendment to this agreement or attaclunenCs hereto map , � be made only with the consent of the�parties hereto. ( i I I 1 VIII. MISCELLANEOUS PROVISIONS � � t The lead agency, proponent and Forest Service shall �ointly establish i � � the outline of study (or any amendments), and. terms of coatracts with � any consultant(s) agreed upon. The consultant(s) will report first in draft form, then in final form, to both the proponent and lead agency; and the proponent will be furnished . ' with copies of all correspondence between the consultant(s) and lead S -� agency. � Each consultant contract will include a provision assuring the consultant's independence and neutrality; and that any bias or predispositions have been (or will he) disclosed to all parties. No contract is. to be awarded until the professional qualifications of the consultants have been verified to` � the satisfaction of the proponent, lead agency and Forest Service. ; ` �� To the extent that the application already satisfies some requirements of � � this agreement, the consultant(s) will merely verify the material submitted. j P. � Any party may hire any additional consultant(s) at its own costs and without the approval of the other parties hereto. - ' i .
