P�nder £or. the recon�t.ructioii of. a segmeni: of the Sopris Creek Road �

Since Pitkin Couni:y v�i.shes to i.t�provc thi.s road f.or reason� of
public safety and since Mr. Fencler is agr.eeable to these improvements
to the extent that they not inter£ere �•�ith his ranching operations, ;
the following conditions are accepted:
-j Mr. Fender agrees:

i To allow Pitkin County or their agents to widen and realign the ;
existing right-of-way to a caidth of. forty (90) feet; �

To grant to Pitkin County an easement to allotv perpetual public '
iuse of this riyht-of-way for ingress and egress and normal operations � .

To construct and maintain a paved surface road twenty (20) feet in
width within this right-of-way; � '?

:o construct new fence on both sides of the forty (40) foot right-of- �
kay to the followinct agreed specifications: . ;,;
All neF� fences �aill consist of 3' "hoa r.iesh" wire with
three strands of barbed wire above. The £ence will be �
constructed on 6' steel posts @ 12' centers with iwo, �
��� (2" to 3") wood stays at intermediate locations. Wooden ��,
three post corners v�ill be constructed at all angle points �
'€ and gate locations and the gates wi11 be fror.i "Powder '=
River" or a sir.iilar sturdy brand. The gates will be �
� constructed to be raised in the winter and all fence �
`� construction �vill be complete and built in a professional �
'�; manner. In addi.tion, culverts will be placed in i:he road 3
� ditches at all gate locations. �°
� To ha�e the pavement in place no later than July 1S, 1979, provided, �
-`ti; however, that no problems unforeseen at this tii*.!e develon such as
natural.disaster, labor strikes, material shortages or the unavail- �
� ability oE a paving con�ractor. If such an un£oreseen problem � •
develops, dust oil or some suitable dust contr.ol suhsta�:ce ��ill be
r. applied peri�dically until the paver.ient is placed; ��

� traffic during cattle movement along the road right-of-way, and to id
inform the local tra£fic en.forcer.ient agency about the purpose and
validity of these traffic control devices £or the purpose o£ en- ,

� reasonable and prudent manner and only for the intended purpose; �:
