finishing the work, such excess shall be paid to the contractor. �
�� If such expense shall exceed such unpaid balance, the contractor �

>� the expense inewcred by the owner as herein provided, the damage
y� incurred through the contractor's default, and the amount payable

"`' Article V. Should the Contractor, responsible for the work
� fully described herein, be delayed in the prosecution or completion
�� of the work by the act, neglect or default of the owner or of any

�s other contractor empZoyed by the owner upon the work, or by any
,� damage caused by fire or other casualty for which the contraetor
�
shall not be responsible after the full exercise of due and proper
�
�:j care, foresight and precaution. or by combined action of workmen
`�� in no wise caused by or resulting from default or collusion on
the part of the contractor, then the time herein fixed for the �
�� comp2etion of the work shall be extended for a period equivalent
� to the time lost by reason of any or a12 the causes aforesaid.

� Such extended period shall be determined and fixed by the�'County
Manager.
' Article VI. It is further mutually agreed between the parties
'. � hereto that no certification given or payment made under this contract.

Article VII. The owner shall, during the progress of the �'?

work, maintain a standard fire insurance policy with extended �'
�'� coverage with 90 percent coinsurance clause on the work covered �'

under this contract while on the premises. �:

Article VIII. The contractor, before starting work, shall
i certiEy to the owner that he carries ample Workmen's Compensation '�...
insarance and has ia fu21 complied with the insurance clauses as �
set forth in the specifications.

Article IV. Contractor agrees that neither he as contractor,

nor his subcontractors, will discriminate against any employee or
applicant for employment to be employed in the performance of this
contract with respect to his hire, tenure, terms, conditions or.
privileges of employemnt, or any matter directly or indirectly
related to employment, because of his race, color, religion, national
- origin, and ancestry. Breach of this covenant may be regarded
as a materia2 breach of the contract.
� Article X. Payment shall be on a cost plus 15$ fee hasis.
Attached to this contract is an estimate project cost of $4,903.60. '�`
� Unless there are major changes in the scope of work, the cost is
expected to be reasonably close to the estimated amount. The

{ Contractor is to inform the County Manager as soon as possible if

- i � the cost estimate will be significantly inczeased £or any reason. '�
� - The parties for themselves, their heirs, successors, executors, �
-:� � administrators, and assigns, do hereby agree to the full performance

of the covenants herein contained. �
