RESOLUTION OF THE BOAFtD OF COUNTY "
COT3MISSIONERS OF PITKIN COUNTY, COLOk2AD0
CHANGING VARIOUS PROVZSIONS OF THE COUNTY'S
ANTMAL CONTROL REGULATIONS

WHEREAS, the Pitkin County Animal Warden has recommended
various amendments to the County's animal control regulations
affecting the licensing and control of dogs, a1Z of which

recommended changes are deemed appropriate,
� NOW, THEREFORE BE IT RESOLVED by tbe Board of County
Commissioners of Pitkin County, Colorado, that Title VI
"Animal Control Regulations" of the Pitkin County Code be
amended as follows: ,
Section 1
�
Section 1-2.2 be and hereby is repealed and reenacted to
read as follows:
1-2.2 No dog over the age of six (6) months shall be kept,
I harbored, or maintained within the County of Pitkin,
Colorado, unless the owner, keeper or person in
charge of such animal shall annually pay a
designated agent of Pitkin County Eor collection
(as may Prom time to time be determined by the
Board of County Commissioners of Pitkin County)
a license fee o£ two ($2.00) dollars to be remitted
to Pitkin County as directed from time to time by
the Board of County Commissioners £or each and
avery dog owned, kept or harbored. For purposes
of this Section 1-2, persons authorized to perform
vaccinations against rabies may be designated as
agents for Pitkin County for the collection of
license fees hereunder.
Section 2
Section 1-2.4 be and hereby is repealed and reenacted
to read as fo2lows:
1-2.4 The provisions of Section Z-2.2 shall not applp to �
• a dog whose owner is a non-resident temporarily
within the County; nor a dog brought into the
County for the purpose of participating in any doq
show, fieZd trial or race; nor to a "seeing-eye"
dog properly trained to assist blind persons, when
such dog is actually being used by a blind person
for the purpose of aiding him in going from place
to place. (For purposes of this Section, a person
shall be deemed a resident if he remains in Pitkin
County for a period of thirty (30) consecutive days.)
`• In addition, no license fee shall be imposed for the .
licensinq of a dog whose owner is sixty five (65) .
years of age or older (limited to one dog per person) . ,

Section 3
Section I-7 be and hereby is repealed in its entirety
and reenacted to read as foI.lpws:
1-7 Dog Running At Large; Harassment
1-7.1 Zt sha11 be unlawful for any owner, possessor, or
any person who keeps any dog to permit that animal
to run at large within the unincorporated portion
of the County of Pitkin, State of Colorado, unless
said dog is within or under the positive control
� of the owner, possessor, or keeper thereof. A
� dog sha1l be deemed under positive control when
; said dog is accompanies by its owner, possessor,
keeper or his agent or servant or a member of his
immediate family and within sight and hearing
� distance of said person.
1-7.2 For the purposes of Section 1-7.1. a doq shall be
} deemed running at large when oEf or away from the
premises of the owner, possessor or keeper thereof,
in any zoned portion of Pitkin County on any public
; road or right-of-way and in any place or places in
the unzoned portions of Pitkin County where the
public gathers or congregates, ie, public parks,
recreational areas, business establishments,
schools and special public events, but not limited
- thereto, and not under direct control of the owner,
possessor or keeper or his agenfi or servant or a
member of his family either by leash, cord or chain
no longer than ten (10} feet in length and of
sufficient strength to completely restrain the
dog, or within a vehicle or other confinement.
In addition, a dog shall be deemed running at large
if a female in heat which is not securely confined
in an enclosure capable oE restricting entry by
other dogs; or if a dog tethered by a Ieash, chain
,or cord which blocks a public thoroughfare.
1 1-7.3 It shall be unlawful for any owner, possessor, or
- any person who keeps or harbors any dog to permit .
that dog to harass any animal within the unincor-
porated areas oE Pitkin County. A dog shail be
deemed harassing when it shall harass, chase or
attack any Zivestock or wildlife, whether or not it
inflicts injury.
1-7.4 The control provisions of this Section 1-7 shall �
' not apply to dogs while actually working livestock,
locating or retrieving wild game in season for a
licensed hunter, or assisting law engorcement
officers or while actually being trained Por any
of these pursuits.
Section �
Section 1-14.3(d) be and hereby is repealed and reenacted ,
to read as follows:
(d) Other provisions of this Article to the cantrary
notwithstanding, a person charged with owning,
keeping, possessing or harboring a vicious dog, or
one found harassing other animals (as described in
� Sections 1-7.3 and 1-9, respectively) shall proceed
to appear in court for such otfense and no admin-
istrative assessment shall be established for
such violations.

� 5ection 1-14.1 be and hereby is repealed and reenacted to
,� r•ead as follows:
.'; 1-14.1 Except as otherwise pxovided in this Article, a
,i person charged with one or more violations of this
regulation listed in Section 1-14.3 shall .have ths
'� option of paying a :handling, processing and admin-
instrative assessment therefor to a designated
,i county agent, the Pitkin County Ani.mal Control
� QEficer or his authorized agents, in lieu o£ further
!,a proceedinqs in court to defend such charge as
described in Section 1-20 of this Artic7.e. If
suah person elects to appear in court, he shall be
proceeded against as otherwise provided by law '
for the vio2ations charged and shall be subject to
the penalties provide8 for in said Section 1-20
hereof, if found guilty of such charges.
Section 6
Section l-I4.3(a) subsections (3), {4) aad (5) be and

:�; (b} In determining the appropriate penalty assessment ,
- for a violation of the "DOg Running At Large"
Sections, the first offense shall be deemed the
;: first violation occuzring after the date of the
.'`�,�, issuance of the license tag worn by the offending
,:' dog, or simply the first such violation in the
.�: case of an unlicensed dog. The numbering of such
offenses shall be deemed to beqin anew on the date
' a new animal license is issued for a dog, provided
that if such new license is issued fewer than
� eleven (11) months from the date a former license
was acquired hereunder, the numbering of such _
offenses shall not begin anew until the actual
expiration date of the former license.

� Section 1-I4.3(c) be and hereby is repealed and reenacted

�j (c) All £ees assessed pursuant to this Article may be
� . collected by a designated County agent, the person
ij in charge of the place of impoundment, or the
S Pitkin County Animal Control Officer or his
`! authora.zed agents and sha17. be remitted as may be
directed from time to time by the Board of County
Commissioners; provided, however, that any additional
+;. fees assessed for Running At Large attributable
merely to the fact that the dog was unaltered
at the time of the violation, may, pursuant to
`� procedures established by the Animal Control Of£icer,
,� be rebated if applied to the direct cost of altering
%; said dog.

, Section 10
Section 1-20(c) be and hereby is repealed and reenacted
to read as follows: �
`� (c) If the Court sha1Z find that any dog complained ;

of is vicious as defined in Section. l-9, or guilty
of harassment as,defined in Section 1-7.3, in addition
to any fine or sentence imposed, the Court may
issue an appropriate order to the owner or keeper �:�
to restrain the o£fending dog, or (in the case of '
'� a vicious dog) he may order the dog disposed of. �
`+ The failure or refusal of any party to do as so ,�
� ordered shall be deemed to be a separate and
;, distinct offense and each day`s violation thereof M
