Colorado r'' Section 1 `-j That Section 10.03 of the Land Use_Code be amen@ed by the addition of a new subsection d. entitled "Requized Removal of Improvements" to read as follows: d. Required Removal of Improvements. In addition to all other powers herein given, the Buildiag Snspector is hereby authorized to require the immediate removal of any and all fixtures, utilities, appliances, structures, or other improvements designed to make an area useable for human habitation (whether or not presently so used) when such use is not permitted • by applicable provisions of this Code. ' 3 Section 2 That the Lattd Use Code be amended by the addition of a new Section7.0.05 to read as £ollows: 10.05 Judicial Review by Board of County Commissioners 1 _ There is hereby granted to the Board of County - Commissioners authority to initiate and pursue ^�� jndici.al review of any final action of any admin- :��i istrative of£icial, the Board of Adjustment and ` Planning and Zoning Commission taken pursuant to the pzovisions of this Code. ��< . �'� Section 3 �-; {"�:i That the Land Use Code be amended by the addition o£ a U,: '� new Section 3.08.11 to read as follows: �Y vi � 3.08.11 Temporary Uses �� � :a, The Board of County Commissioners may, on receipt �- of an appliatzon therefor, permit the use and *�; ' oceupancy of any lands within Pitkin County for temporary commercial uses not otherwise permitted '�� herein, provided that: � �t: �;; l. The Board shall have determined that permission to conduct commercial activities is necessary to hqld a pubZic event or celebration and that adequate provision has been made for police supervision, � area maintenance and public parking. 3. Any structures constructed or placed on the premises shall conform to any and all requirements of applic- able building codes and other regulations of Pitkin County. b. The provisions of subsection a, to the contrary notwith- -" standing, the Building Inspector may permit a single vendor of agricultural products to engage in the sale of his products provided that he shalZ determine that the vendor's location creates no traPfic hazard, and that the operation (and structures, if any) otherwise complies with . relevant building codes and other regulations of Pitkin " County. Such permission shall issue for a designated site and for a period not to exceed seventy-two hours. � c. Any temporary commercia3 use (which includes sales from vehicles) not authorized as herein above described shall be deemed prohibited. � Section 4 That Sections 3.03, 3.04 and 3.05 of the Land Use Code be amended by the addition of a new use category "BUS Stop" to be "A: Use Allowed by Right" in all zone categories, Section S That the Section 12 "Definitions" of the Land Use Code be ! i amended by the addition of "Bus Stop" to read as follows: � "Bus Stop: An area consisting pf a bus turno£f, bus stop sign and/or passenger shelter." Section 6 That the first sentence of Section 5.90.04 a.2. of the Land Use Code be repealed and reenacted to read as follows: "The Planning Office shall evaluate all development allotment applications during the months of June and July, reject those that are ineligible under Section 5.90.03 b and present its recommendations to the Pitkin County Planning and Zoning Commission no later than August lst of each year or the Commission's first regular meeting subsequent to that date," And that Section 5.90.05 a.4, of the Land Use Code be repealed � and reenacted to read as foi.lows: , "All projects sha11 be ranked according to the total points received (highest to lowest) and the ranking thus established by the Commission shall be forwarded to the Board of County C.ommissioners on or before October lst of each year." And, finally, that the second sentence of Section 5.90.05 a.6 of the Land Use Code be repealed and reenacted to read as follows: "Subsequent to the conclusion of all protest hearings provided for in this Section, during which the Board may change the number of points awarded to any protesting applicant, the Board shall, by resolution and prior to Novemher lst of each year, allocate development allotments among eligible applicants in order of priority estahlished by their rank." - 2 - �,. ,,�r;a � + �:.:.�1' - i '•'.�^::di�'� ., . .°.:::�1,�'�.�j2�r . Any development needing special review, sub- division, PUD or rezoning approval whiah has received a development allotment shall be deemed to have satisfied tha provisions of � Section 6.03.04 c. of the Pitkin County Land Use Code, and the applicant may proceed to public hearinq before the Board of County Commissioners. Applications £ailing to receive any allotment shall be deemed finally denied and processed no further under the provisions of said Land Use Code.
