WkEREAS> James Mollica is the record owner of Lots 2 and 3, Lime Viliage r

Subdivision, Fiiing No. 7, according to a plat thereof of record in Book 4 �
at Page 14 of the records of the Pitkin County Clerk and Recorder, and �
; WHEREAS, the owner has requested permission to separately develop Lot 3 �
t pursuant to the provision of Section 7.22 of the Pitkin County Land Use Code
t

permitting the separate development of substandard contiguous lots under $
I
single ownership upon special rev�ew approval, taking into consideration the - i
following criteria:
1. 1'he number of substandard size lots developed in the area and the
effect of separate deve7opnent upon the character of the neighbor-
hood and purposes of the zone category;
2. The extent to which the lots comply with existing subdivision �
- negulations; g
3. The effect of separate development on available utilities, roads � -
and other public facilities; g

4. Any physical limitations of the lots; �
5. The configuration of the lots as it affects their suitability for
separate development; � `
6. The degree of economic loss to the owner if separate development
permission is not granted (including a consideration of the value �
of the lots if separately developed vis-a-vis, their value if used
in connection with each other);
,: 7. The history of acquisition (including a consideration of purchase }
and whether or not the lots were invo7untarily acquired); �

8. This historical use of the lot. �

WHEREAS, the Planning and Zoning Comnission did, on December 20, 1978, I

consider the application and recommended approval thereof with the following �
conditions: �
1. The bu9lding site is restricted to the upper half of the lot, from �
the knolT up.
2. The sewage disposal system must be designed by an engineer to the
satisfaction of the County Sanitarian.

3. There must be submitted a drainage plan and an engineered foundation
plan. j
;'. WHEREAS, the Board of County Coranissioners, after conducting a pubTic�

hearing on February 12, 7979 and having heard the evidence and testimony �
presented with respect to the application, have determined to approve the
� special review application.
NOW, 7HEREFORE, BE IT RESOLVED by the Board of County Comnissioners of
Pitkin County, Colorado, that it does hereby grant James Moliica special "
review approva7 for the separate development of Lot 3, Lime Village Subdivision,
Ffiiing No. 1, sdbject to the following canditions:
1. The building site is restricted to the upper half of the lot, �
from the knoll up. �
: 2. The sewage disposa7 system must be designed by an engineer to the
satisfactiort of the County Sanitarian.
6 3. There must be submitted a drainage pTan and an engineered foundation
• plan.
4. There must be subm9tted a letter fran the Fire District stating
�� that access is adequate or stating ways to mit�gate the access
problem.
