RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, REQUIRING THE

ABATEMENT OF THE COMMERCIAI, USES WITH i
t'� THE HOLLAND HILLS WINDMILL BUILDING

� WHEREAS, the Board of County Commissioners of Pitkin
County, Colorado, with the adoption of its Resolution 78-23, �'

has established a procedure for the considerat,ion of applications =
�: for exemption from (or increased amortization periods with _
;;;i respect to) the abatement provisions of the Pitkin County ;

Land Use Code, and 1
;�%; WHEREAS, an app2ication for exemption or an increased
�`� amortization period has been received foz continued use of y�

the windmill adjacent to the Holland Hills subdivision for �s

-_ commercial purposes, and €�
WHEREAS. subsequent to the receipt of a recommendation �

from the Planning and Zoning Commission, the Board did, on �
'}.� March 26, 1979, after proper notice had been given, conduct '��
a public hearing on the application, and 'S
� WHEREAS, upon reviewing the recommendation of the Planning '��
��
' and Zoning Commission and Pitkin County Planning Office, and ;,4

exhibits, testimony and comments of the Applicant and members ��
k�x of the public, the Board has determined that the applicant has `�

'�`� presented no evidence to support an application for exemption "„
,,� ,i
(or increased amortization period) from the abatement provisions �

�� of the Pitkin County Land Use Code, ;a

NOW, THEREFORE, BE IT RESOLVED by the Soard of County =

�;1 Commissioners of Pitkin County, Colorado, that continued ^�
�{; use of the windmill for commercial purposes is in derogation ``�
�, ;�
v; of-the present zoning of the area, and undermines the purposes :
�;,� ;
w of the zone category; and, further, the applicant has offered

�^ nothing to mitigate these effects nor demonstrated any grounds r
`; for exemption (or an increased amortization period) under the :;
�
� criteria established in Section 7.12 (as amended) of the Pitkin
i,
� County Land Use Code.
� SE IT FURTHER RESOLVED, that commercial use of the
