OF PITKIN COUNTY, COLORADO, EXEMPTING TOKLAT RESTAURANT
AND PINE CREEK COOKHQUSE FROM THE ASATEtQENT

PROVISIONS OF THE PITKIN COUNTY LAND USE CODE I

WHEREAS, The Board of County Commissioners of Pitkin !
County, Colorado, with the adontion of its Resolution 78-23, �
$
has established a procedure for the consideration of applications -
for exemption from (or increased amortization periods with respect
to) the abatement provisions of the Pitkin County Land Use Code, and ;
�+1HEItEAS, an application for exemption or an increased,amortization
� ` i
period has been received for the Toklat Restaurant, and Pine ?
t
Creek Cookhouse, and �

FIHEREAS, subsequent to the receipt o£ a recommendation from �
the Planning and Zoning Commission, the Boarcl did, on March '
26, 1979, after proper notice had been given, conduct a public
hearing on the application, and
WHEREAS, upon reviewing the recommendation of the Plannina
and Zoning Commission and Pitkin County Planning Office, and ,
`� �� exhibits, testimony and comments of the Applicant and members
! of the public, the Board has determined that these uses contain �
on site employee housing, the loss of which would exacerbate the
shortage of employee housing within Pitkin County; but, except �a

for this consideration, (the efPects of which can be mitigated } L
: by complianae with the condition stated below) these uses �
; create no severe adverse land use impacts requiring abatement
� pf them as nonconforming use, �

NOW, TAEREFORE, BE IT RESOLVED by the Board of County

; Commissioners ot Pitkin County, pursuant to the provisions of �
� Section 7.12 of the o£ the Pitkin County Land Use Code, that the '
2 Toklat Restaurant and Pine Creek Cookhouse are hereby exempted f
�
from the abatement provisions of Section 7.10 of the Pitkin County I
�
� Land Use Code conditioned upon compliance with the following: �
The Applicants shall maintain as employee housing those units �
and areas presently used for this purpose (or comparable i
y substitutes); provided, however, that this condition may be i

waived by the Board of Countl Commissionezs on request of
either of the Applicants if they shall demonstrate that nain-
. tenance of employee housing on site is undesirable or in- •
feasible. �
BE IT FURTHER RESOLVED by the Boaxd of County Commissioners
that for the purpose of en£orcing the provisions of this �
fi resolution the Board makes of record the followinq information �
