� RESOLUTION OF THE BOARD OF COUNTY COA4MISSIONERS

OF PITKIN COUNTY, COLORADO, AMENDING VARIOUS
SECTIONS OF THE LAND USE CODE CDNCERNING
APPLICATIONS FOR SUBDIVISION APPROVAL OF LOT SPLZTS

WHEREAS, the Board of County Commissioners has initiated
� various amendments to the Land Use Code with respect to j
� applications for subdivision approval for lot splits, and
! WHEREAS, the Board having conducted a public hearing on
, the proposed amendments on May 14, 1979, and having considered ' '
�
! the recommendations of the Planning and Zoning Commission and
� Planning Office, and testimony of participants at the public
�# hearing, the Board wishes to adopt the proposed amendments, �

NOW, THEREFORE, BE IT RESOLVED by the Board of County
�� s
Commissioners of Pitkin County, Colorado, that Section 4.09,
5.30.03, and 5.90.O1c of the Pitkin County Land Use Code be ''

repealed and reenacted to read as follows: 1

4.06 Annual Review of Subdivision Applications. In
order to meet the objectives of the Aspen/Pitkin �
�. County Growth Management Policy Plan, subdivision ';
applications shaZl be submitted and considered only ;;
once a year. Applications shall be submitted to the
Planning Office no later than June lst. A public
• notice that applications are being accepted shall
be given no later than the first day of May by at
least one publication in a newspaper of general :'
circulation in the County.
The above requirements notwithstanding, any appli-
�`' cation for a subdivision exemption or subdivision -
`;a approval for a lot split may be submitted and ,
; considered at any time during the year. For the '
;j purposes of this Section 4.06, and Sections 5.30.03, ��� -
and 5.90.O1c, a lot split is defined as the division of �x
a pazcel of land, being a part of an on-going °
aqricultural operation (and classified as agricultura].
� lands by the County Assessor) lying within the AP'-1,
AF-2, RS-20 or the RS-30 zone districts, into no more
;� than two sinqle family lots. This waiver from the ;
',i annuaZ application requirements for applications for
� a lot split shall be aZlowed for a given parael of
j I.and only once, and upon the further subdivision of
;� either lot full compliance with the annual application
� requirements shall be met.

� 5.30.03 Conditions for Waiver. The housing requirements of ;
this Section 5.30. sha11 be waived for residential
developments on lots formed by a 3ot split as
defined in Section 4.06, provided, however, that such
waiver shall be granted for a given parcel of land
on2y once and upon further subdivision of either lot
f full conpliance with the housing requirements established
in Section 5.30 shall be met. ;.
