HomeMy WebLinkAboutbocc.res.176.2001 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITIQNN COUNTY, COLORADO,APPROVING AN AMENDMENT TO THE 1997 ASPEN HIGHLANDS AF-SKI MASTER PLAN FOR LIMITED NIGHT-TIME USE OF THE CLOUD NINE RESTAURANT DURING THE WINTER SEASONS OF 2001/2002 AND 2002/2003 Resolution No.jL-2001 RECITALS 1. Aspen Skiing Company("Applicant")has applied to the Board of County Commissioners(`Board") for an amendment to the Aspen Highlands Ski Area Master Plan for approval for night-time use of the Cloud Nine Restaurant. 2. Night-time events at the Cloud Nine Restaurant are not specifically mentioned in the Highlands Ski Area Master Plan,pursuant to Resolution No. 97-199. 3. The Planning and Zoning Commission reviewed this request and recommended approval subject to conditions on August 14,2001. 4. The BOCC considered the request at a regularly scheduled meeting and Public Hearing on October 10, 2001. 5. The BOCC finds that it is appropriate to approve the request for a limited two season period with further review and evaluation required for any extension. NOW,THEREFORE,BE IT RESOLVED by the BOCC that it does hereby approve an amendment to the Aspen Highlands Ski Area Master Plan for limited night-time uses of the Cloud Nine Restaurant, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1. The Applicant may operate the restaurant for dinner for a total of up to 50_evenings during each of the winter ski seasons of 2001/2002 and 2002/2003. 2. Access to and from Cloud Nine for night-time use by guests shall be provided by snowcat only. Staff may access by snowmobile. 3. Guests will depart for Cloud Nine from the Highlands base area at 5:30 p.m. and will return to the base area by 11:00 p.m., with two exceptions: on New Years Eve and on one other night to be selected by the Applicant the guests will be returned to the base area by 1:00 a.m. Resolution No.)Y-2001 Page 2 4. Prior to the first of event of each winter season,the Applicant shall: A. Submit an insurance certificate for review and approval by the County's Risk Manager. The certificate shall list Pitkin County as an additional insured. B. Provide notification of the events to the public in the newspaper and mail notice to the properties at the base of the mountain. C. Provide verification that Cloud Nine's retail food license has been properly renewed. D. Provide verification from the Environmental Health Department that the restaurant meets all food service establishment requirements to operate in the manner intended. E. A comprehensive life, safety, and evacuation plan shall be reviewed and approved by the Pitkin County Emergency Management Coordinator. F. Provide verification that all life safety systems, fire alarm, fire sprinkler, and kitchen hood cooking systems shall be in compliance with inspection requirements. G. Provide verification of Forest Service approval for the operation. 5. The Applicant shall provide the Community Development Department an annual report by June ls` after each season's activities on the following issues in order to measure the impacts of the approved night use: number of events,dates of events,number of participants per event,safety issues,parking, employees generated, lighting,noise,air quality,public comment. The Community Development Director will determine whether impacts generated or public comments warrant review of the annual report by the BOCC. The BOCC may in its discretion at that time alter conditions of approval or revoke the permit. 6. There shall be at least three employees trained in first aid, including at least one Emergency First Responder,present at each event. 7. If the Applicant wishes to pursue an application for the activity beyond the 2002/2003 winter season,an application for extension shall be filed by August 1,2003. This application shall include a detailed analysis of the FTEs generated by the night time activity and a proposed method for providing required housing mitigation.
