RESOLUTION OF THE BOARD OE COUNTY �1� I'ALE�F+V
COMMISSIONERS OF PITKZN COUNTY, COLORADO,
AMENDING SECTION 302(d) OF THE UNIFORM
BUILDING CODE CONCERNING THE EXPIRATION
OF BUILDING PERMITS

WHEREAS, the Board of County Commissioners, pursuant to the '

1 authority given in C.R.S. 1973, Section 30-28-204, wishes to amend
� the 1976 Edition of the Uniform Building Code as to establish more
precise requirements with respect to expiration of buildinq permits
� and obligations of a builder on expiration, ;
�
;S NOW, THEREFORE, BE IT RESOLVED by the Board of County
t Commissioners o£ Pitkin County, Colorado, that Title VII, Article
2, of the Pitkin 'County Code (Building Regulations) be amended by
the addition of a new Section 2- *to read as follows: �

� 2- *Section 302(d) is repealed and reenacted to read as � .
follows: `

(d) Expiration. Every permit issued by the building "�
- official under the. provisions of this code shall
expire by limitation and become null and void if �S:
the building or work authorized by such permit is :
not commenced within one hundred twenty (120) days ��
from the date of issuance of such permit. Except with
- respect to the construction of a single family home
� by the owner thereof, work equal to ten (10) per '
cent of the valuation of the entire project must be
completed in each sixty-day period thereafter until
completion of the project or said project shall be _
deemed abandoned and the permit expired. In the event
a permit shaZl expire, the following provisions shall -
1 apply, namely:
�
1. All below grade excavation done in anticipation of
construction shall be filled within thirty (30)
� days of expiration such as to bring the site to
� a condition comparable to that before permit
;� issuance.
'� 2. Any fences, railings, canopies and other protective
;; structures placed in a public right-of-way, as well
as all hazardous conditions or improvements, shal.l
,. ;� be eliminated or removed within 10 days of `;�
? expiration of a permit.
i� 3. Before such work can be recommenced a new permit
'� shall be first obtained so to do. Such permit shall
� issue for a permit fee equal to one-half (�) the
amount required for a new permit for such work
�,y provided no changes have been made or will be made
� in the plans and specifications for such work, and
� provided further that the work has not been aband-
oned for a period exceeding one year. -
4. The provisions oE subparagraph 3 to the contrary
notwithstanding, no permit shall reissue for any
construction or activity prohibited by law at the
time of the application for reissuance.

accordingly.
