'f WHEREAS, this zone district provides that "Outdoor ? recreational uses and facilities provided retain natural environmental conditions and no outside equipment storage and no excessive noise, odor, dust, vibration or otherwi�e a nuisance" is a use which may be permitted by special review, and '? WHEREAS, Sec�ion 3-6 of the Land Use Code provides this; "Uses designated as special review uses in any zone `:,. district or by any general regulation are contingent uses which which may or may not be appropriate in a particular location depending upon the nature of the use, its relationshig to surroundino land use and its ;�� impact with respect to environmental, social and economic matters. Special Review Use Permits may be approved by the Board only after reviewing the impact of the particular use in the proposed location on adjacent land uses, the . environmental, social and economic characteristics of the _ j area, and the community in general, and only upon a finding that the use is compatible with the policies and requlations � of this code." AND WHEREAS, the application was considered by the Board of County Commissioners at a public hearing held on July 23, 1979, and � .�. continued to August 13, 1979, at which times the Board received exhibits and heard comments from the applicants, planning office - and public at large, and WHEREAS, upon reviewing the,comments heard and exhibits and ' � the recommendation of the Pitkin County Planning and Zoning Commission the Board has Eound this: (a) Mbst particig�nts in the review proceduxe opposed � the application (including among others, the Aspen Wilderness P7orkshop and the Roaring Fork Group of the Sierra Club) for many reasons some of which are itemized below. Flhile not controlling, this opposition does make clear to the Board that a '�., substantial segment of the population finds the proposaZ contrary to the community's interest. (b) The Director of the Department of Transportation , has estimated that installation of the slide will result in 190 additional trips an Maroon Creek Road. Maroon Creek road is designated a medium rural arterial with a roadway capacity of 2,500 to 4,000 per day. ' � • �� � _ ., _ . . - ` ° ` ��vi.. �� �� . ��'��'�.'',,."�,%. 6,090. Installation of the slide would increase traffic by 38, on a roadway more than 50$ over � capacity at the present time. This factor, plus the acknowledged hazardous conditions at the Highway 82/Maroon Creek Road intersection makes the increased traffic generated on Maroon Creek Road unacceptable. ? (c) The applicant has introduced a noise study v�hich determines noise levels within legal limits. However, these results have been questioned because (1) measurements were not taken from points most directly affected (e.g. La Chamionix) and (2) did i ' not consider special acoustical characteristics of � the valley which, its residents insist, amplify any i serious noises made; and � (d) 'Ihe improvements proposed will be visible from great � a distances along the Highway 82 corridor and Sardy � Field; and � (e) The AJ.pine Slide will be adjacent to an area � substantially developed as a residential neighborhood; ; and ; (f) In addition, the proposal lies at the entrance to � the Maroon Bells Wilderness area and other forest ! . � service lands, dedicated and operated almost � ;: exclusively as wilderness or low usage public lands; � ` (g) The use introduces a recreational activity not r; encouraged by the Aspen Area General Plan (as � u' amended); and its economic benefits to the community • 's r� will be minimal; � (h) There is evidence that the slide may create airborn � ashestos fibers in the area where two schools and i� city supported recreational facilities lie; and � � (i) The project, as a whole, does not conform with the �. ;; goal of the community to maintain the area's scenic 'd a quality and superior tourist experience; and � : � -' WfiEREAS, having determined the foregoing the Board has � � � concluded that: � +?
