APPROVING THF DETAILED SUBMISSION r

WHEREAS, Mary Frank, owner of the Abacus Ranch within Pitkin County, was i

granted conditional approval of the General Submission for Frank Subdivision g
Filing 3 by the Board of County Comnissioners of Pitkin County, Colorado on ;;
December 11, 1978, and �

WHEREAS, the applicant filed the Detailed Submission application and �
presented said application to the Planning and Zoning Canmission on September �
5, 1979, and �

WHEREAS, said application was recommended for conditional approval by the �
Planning and Zoning C�nmission on September 12, 1979 (Resolution 79-17), and
WHEREAS, said application was presented to the Board of County Corttnissioners
' on September 24, i979.
NOW, THEREFORE, BE IT RESOLVED tfiat the Board of County Cortmissioners of �
Pitkin County, Colorado approves the Detailed Submission of the Frank Subdivision �
Filing 3. �

BE I7 FURTHER RESOLVED that said approval is conditioned on the following �
considerations:
1. That the three restricted single family lots be sold under the guide-
�
lines for "middle income" employees. �'`
2. That the road network serving the development not be dedicated to �
the public and that the single cul-de-sac access be permitted �
�
provided that a second emergency access be maintained at ail times �
a�d the right to dedicate said roads to the public be preserved by the :�
�

5. That the following conditions of Comnissioner approval of the General
Submission remain effective:
a. The granting of right of access to the Pitkin County Animai

Control Officer for verification of dog control.
" b. Preservation of irrigation and utitity easements in the name of

the owner. '
c. Prohibition of discharge of firearms.

d. Creation of homeownar's association for maintenance of improvements, i �
including roadways, water system and common pasture which cor�nen �t

pasture shall be restricted to be leased by the homeowners to the r

� owner of the ranch for so 7ong as the owner's ranching operations
continue.

e. Keeping of horses and cattle only within an area designated within 4

the comnon pasture so as not to interfere with the owner's �

' ranching operations, {Animal carrying capacity of common area �
to be determined by Extension Agent). �

f. Fencing to accommodate these goals, but not including fencing {�
