Oct 30, 1979 Loretta Banner Recorder Reception No: ,7����,�� ��,{.,• RESOLUTION OF THE BOARD OF COUNTY ��V�`� FAG��(V COMMISSIONERS dF PITKIN COUNTY, COLORADO AMENDING THE PITKIN COUNTY LAND USE CODE WITH RESPECT TO LOT SPLIT APPLICATIONS S Resoltuion No. 79-�p� � -� ; WHEREAS, The Board of County Commissioners, at its public � � hearing conducted on September 24, 1979, and later on October 9, 1979, has considered various amendments to the "lot split" provisions `:i of the Pitkin County Code, and WHEREAS, it has determined to adopt those amendments recommended for approval by the Planning and Zoning Commission, ;`� NOW, THEREF012E, BE IT RESOLVED by the Board of County :.g Commissioners of Pitkin County, Colorado, that: =>r � Title II, Section 4-6, Pitkin County Code (Land Use Code) be - ^; amended by the repeal and reenactment of the section to read as i' - � follows: "Annual Review of Subdivision A plications. In order to ; meet t e ob7ectives of the Aspen/Pitkin County Growth , xa Management Policy Plan, subdivision applications shall be submitted and considered only once a year. Applications <� shall be submitted to the Planning Office no later than June lst. A public notice that applications are being � accepted shall be given no later than the first day oE May by at least one publication in a newspaper of general circulation in the County. The above requirements not � withstanding, any application for a subdivision exemption '( or subdivision approval for a lot split may be submitted �� and considered at any time during the year. For the ,! purposes of this Sectian 4-6, and Sections 5-300.3 and a 5-5.10.2(c1, a lot split is defined as: � (a} the division of a parcel of land, being a part of an on-going agricultural operation (and classified as agricultural lands by the County Assessor) lying ,s' within the AF-1, AF-2, RS-20 or the RS-30 zone districts, into no more than two single family lots; _ or (b) the division of a parcel of land into two singZe family lots where both parcels are restricted (by covenant or otherwise) against further development and the subdivision will result in not more than.twenty- �� five (25$) percent oE the density permitted under current zoning. � ti The waiver from the annual application requirements for a �; lot split shall be allowed for a given parcel of land oniy �� once, and upon further subdivision of either resulting lot, �: full compliance with the annual application requirements �'' - � shall be met." �' t 8 � ,�.,,±;t: -ik-.
