GRANTING AN EXEMPTION FROM THE DEFINITION

OF SUBDIVISION FOR THE CONDOMINIUMIZATION �
OF THE POMEGRANATE WEST LODGE �

WFIEREAS, Pomegranate West Development Company, Pomegranate �
IResorts,, Inc., Aspen Grand Development Company, No. 1 Main �

� Corporation (hereinafter referred to as the "Applicants") did ;
i apply for an exemption from the definition of subdivision (pursuant {
to Title II, Section 4-2.2(a) (5) of the Pitkin County Code (Land �
�
`-`, Use Code)) for the condominiumization of the 57 double occupancy �
� lodge/hotel units, restaurant, bar and accessory uses and facilities �
� constituting The Pomegranate YJes�t Lodge, located within Pitkin �
� County, Colorado, and � �
�t WHEREAS, the use lies within the AF'-1 zone district and is, �y
�� at present, a non-conforming use, and �
�. WHEREAS, the Board of County Commissioners did, in its � .
�,
'' R e s o l u t i o n N o. 7 9-4 1 a g r e e t o g r a n t t h e u s e a n e x e m p t i o n f r o m ;�

'` abatement when and if the Applicants shall comply with each of �
� .�
the following conditions: �
=� 1. The Applicants shall execute an avigation easement for �
s: �
- l the benefit of Pitkin County in (substantially) the form •
' �
attached hereto as Exhibit "A". '�
�
2. The Applicants shall berm and/or revegetate the area � �
-� between their parkiag lots and Highway 82 to screen the
� same. Such screening shall meet the approval of the i_

County Engineer and be completed within two (2) years �
n
of the date of this grant of exemption. �
�
3. The Applicants shall maintain as employee housing those �
E
areas presently used for that purpose (or comparable �
• i
substitutes); provided, however, that this condition �
may be waived by the Board of County Commissioners on �
x
request of the Applicants if they shall demonstrate �
�,
that maintenance of employee housing on site is i°
undesirable or infeasible. ;S

;? 4. The Applicants shall, at the County's request, make
� an appropziate dedication (without additional
�
- � consideration) of its land (unimproved with structures)
� needed to construct a frontage road serving Highway
, �
',� 82. i

` ? 5. The Applicants shall, on demand of the County Engineer, �

a close any o£ Applicants' access points from Highway 82 �
� when alternative access from Highway 82 shall become �'
available. �
6. As a condition of the enforcement of the fourth and/ar �
fifth conditions above, the County shall permit the �
Applicanfs to participate in all County discussions oP �
any engineering design solutions to the Highway 82 �.
access problems as they affect the Applicants' land.
7. As a condition of the en£orcement of the fourth
� condition above, the County shall make a determination
f of what constitutes an appropriate dedication based �

� on the equities at that time.
8. The Board may waive the requirements of sections 4 and
� 5 above upon the adoption by the County Engineer o£ a
_� specific plan for the improvement of the intersection .��
of Highway 82 and the Pomegranate Inn and West Lodge; ?l
� � and the agreement by the Applicants to such p2an and � •
�
the making of any dedications or contributions caYled
for therein. �
AND, WHEREAS, the Board has determined that the requested ,,

exemption should be granted subject to certain conditions hereinafter �

enumerated, �3
NOW, THEREFORE, BE IT RESOLVED by the Board of County �s

- Commissioners of Pitkin County, Coiorado, that it does hereby grant k

an exemption from the definition of subdivision for the condominium- �
�
�
ization of the Pomegranate West Lodge, subject to each and every �.
- �
of the following conditions: �S
t.
1. The Applicants shall prepare a subdivision exemption �
plat meeting the approval of the County Engineer. The �
�
plat shall, at a minimum, comply with his previous �
requests that the tracts along the rear of the property
�

not be shown as separate parcels; and that the
land lying under the road easement along the west ;
be excluded from the plat. s

2. The Applicants satisfy all requirements for an
� exemption from abatement specified in Resolution 79-41; �
a
- � provided, however, in the event that it shall be ;
;
determined that the Board of County Commissioners shall �
have been without authozity to impose conditions on
�-_.,-
the exemption herein granted, then those conditions
shall survive and shall remain conditons to continue
the non-conforming use of the premisis.
�
3, The Applicants shall set aside 14 double occupancy ;
;
lodge units and devote the same exclusively for rental �
to on-site employees. These units shall be leased �
for no more than the low income PMti price guidelines as
shaZl be from tirt�e to ta.me established by Pitkin County.
Kitchen facikities-(either spearate or communal) shall be
made available to all `occupants of these employee units. The
kitchen facilities shall meet with the approv�l• of the
County Building Inspector.
4, Except as required by subparagraph 3 above, no kitchen
or cooking facilities sha21 be znstalled in any of the '
lodge units within the Pomegrante West Lodge.
� BE IT FURTHER RESOLVED, as conditions of the exemption herein
� granted, that:
1. This grant of exemption shall in no way constitute a
waiver of any County regulations except those expressly
exempted hereby.
2. The restrictions set forth herein shall run with the land
and be binding upon any subsequent purchaser or successor
in interest.

3. The Applicants shall, by deed restriction, restrictive �

�� covenant, or other appropriate instrument, take such
