WHEREAS, an amendment has been proposed by the Board of County Commissioners

to Section 3-8.13, Employee Dwelling Unit, of the Pitkin County Land Use
Code, and �
WNEREAS, a public hearing was held before the Board of County Commissioners
at their reguTar meeting on December 2&, 1981 at which time evidence and
�, testimony were presented with respect t� :his apllication.
;,; �, NOW, THEREFORE, B£ IT RESOLVED by the Board of County Co�nissioners

�, that it hereby amends Tit7e II of the Pitkin County Code (Land Use Code)
�'� by the repeal and re-enactment of Section 3-8.13, Employee Dwelling Unit,
` to read as follows:
' ' "3-8.13 Empioyee Dweilinq Unit
y'< , (a) The Planning and Zoning Cortmission may by special review

<� pursuant to the procedures established by Sections 6-3 and
t. ,
` 6-6 of this Code permit the constructfon of one residential
dwelling unit (hereinafter "empToyee unit") attached to or
within, a single fami7y home {hereinafter "principle unit")
on any lot which conforms to the minimum lot area requirements
within the R-15, R-30, AF-2 and AF-1 zone districts under the
following conditions and limitations:
_ (1) Newly constructed employee units shall not have more than
one (1} bedroom nor exceed five fiundred (500) square feet e%x� '

for the housing of employees which are employed full time �
on-site. �
�5) The appiicant shall, by deed restriction or other permanent �

commitment running with the land, guarantee that the emp7oyee �i

unit sha71 remain a rental unit, not be occupied 6y owner or �

spouse, be limited to occupancy 6y persons and their families �

p;; (c) The Planning and Zoning Commission shall review applications for !
= approval pursuant hereto, taking into consideration, in addition .
to special review criteria established elsewhere in the Code,
compatibility with the existing neighborhood and availability of �
public and private access, utilities and services. �t_,.-;'

_ - (d) Nothing herein shall preclude the approval, as employee dwelling `�-;�'
units, of units existing on the date of adoption hei•eof, provided �
that the same shal7 meet the requirements of this section. �
(e) All units approved pursuant to Section (a) sha77 be made available �

for rental under the limitations established in Section (a)(4) M

- and all units approved pursuant to 5ection (6) shall be made
available for rentaT under Section (b)(4); provided, however, that

the restrictions of Section (a}(4) shali not be appi9cable in
� the event of occupancy, wi.thout consideration (direct or indirect),

:� 6y members of the immediate family of the owner of the principal
dwelling. "Immediate family" shall .mean a person related by blood �

County Nousing Authority which shall verify the qua7ifications �
