FROM THE DEFINITION OF SUBDIVISION FOR -
THE CONDOMINIUMIZATION OF THE SILVERKING

APARTMENTS (HUNTER CREEK CONDOMINIUMS) �
Resolution No. 82 - 3 � �
WHEREAS, the Board of County Commissioners are parties to a
Settlement Agreement dated March 30, 1981, of record at Book 406 Page
294 of the records of the Pitkin County Clerk and Recorder in which it ;4

agreed to grant an exemption from the definition of subdivision all as
described therein, and
WHEREAS, an application for the exemption has been made which
��� request is appropriately granted,

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners �
:i � of Pitkin County, Colorado, that it does hereby grant an exemption
from the definition of subdivision for the following purposes:

Y-� 1. The condominiumization of the Silverking Apartments located

on an approximately 16 acre parcel of land described on Exhibit -
A of the Settlement Agreement consisting of Phases I, II
and III and including all building and improvements located
on said property.
2. The conveyance to the Pitkin County Housing Authority of >
�;:

a parcel of land consisting of Phase II and any and all other
interests in real property appurtenant thereto. ,
3. The conveyance to the County o£ the following parcels: �

BE IT FURTHER RESOLVED that this exemption be conditioned upon the
review by the County Attorney and Engineer of the subdivision and/or `�'
condominium plats and condominium declarations to determine that the
- same are in conformance with the terms and conditions of the Settlement - ,
