WHEREAS, Christine Sparovic is the owner of record of Lot 1 of the �+
Sparovic Subdivision, and
WHEREAS, Christine Sparovic has requested General Submission Approval for a
�, resubdivision of Lot 1 into two separate parcels pursuant to Section 4-b(b), and �
WHEREAS, a public hearing was held before the Board of County Commissioners �`
at their regu7ar meeting on December 28, 1981 at which time evidence and testimony
were presented with respect to this application. ;`

�; 4 NOW, THEREFORE, BE IT RE50LVED by the Board of County Commissioners of

Pitk9n County, Co]orado, that General Submission Approval is hereby granted to "
the Sparovic Subdivision, Filing No. 2, . for the resu6division of l.ot 1 of

the previous Sparovic Subdivision into two separate parcels each for single

family use subject to the following conditions: `

� 1. Detailed and Final Plats shall reflect a recreational use easement ;?
f� for the water course of the Roaring Fork River as it affects this !;

2. No new road cuts onto Highway 82 wi7] be permitted as access to Lot ]B
wil7 utilize the existing access easement through the Shaimar Apartments r;.

3. The applicant shall execute a main extension agreement with the City of
Aspen's Water Department per that department`s Main Extension Policy or �
o6tain a well permi.t from the Colorado Division of Water Resaurces and c�•
a ground water report pursuant to Section 5-205 of the Pitkin County `�
Land Use Code.
4. Dry wells shall be constructed simultaneously with the house on Lot 16 �;;
to retain roof drainage and paved area drainage.

5. Deed restriction against any further development.

6. The Soard is willing to reconsider the access issue at Detailed Submission F;�-
provided that the applicant obtain a road cut permit from Colorado State f��:.;;;°
