$ WHEREAS, Ted A. Koutsoubos is the owner of two contiguous platted lots �
�� (Lots 10 and 11, Block 4, Filing Two) in the Gateway of Snowmass Mesa Subdivi-
sion, and
� �:
WNEREAS, the Gateway of Snowmass Mesa Subdivision was platted in 1969, '
� and
��
WHEREAS, Section 7-2.3 of the Pitkin County Land Use Code provides that
�
�` ownership of contiguous undersized (by current zoning standards) parcels
�' ; results in a cumulation of the parcels so they become only one parcel for �
w:
�: development, and
,t WHEREAS, Section 7-2.4 provides for an exception to this cumulation with
:`�
� respect to subdivision lots platted before May, 1972 if the special review
, ��
�' results in approval, and
� �,-. ?;
. WHEREAS, the Planning and Zoning Cortmission feels it should be noted that
`� ;` the Colorado Division of Water Resources does not consider the water source
for this subdivision to be reliable since it may technically be subject to
curtailment in the event of a downstream ca17, and that water rights should be
decreed and augmentation plans and other mechanisms be developed to protect
their diversion from downstream calls, and �
WHEREAS, the request is also subject to review under Section 5-400.2 for
development in an area of Wildlife Habitat and Potential Geologic Hazard, and :i
' any problems were found to be insignificant enough to not preclude approval. � ,
NOW, THEREfQRE, BE IT RESOLVED by the Board of County Cormnissioners of �
Pitkin County, Colorado, that Special Review approval is granted for the �
separate development of Lots 10 and 11, Block 4, filing Two, Gateway of �
Snowmass Mesa Subdivision under the following conditions: �
1. That the sewage disposal absorption areas be constructed in Soil Type
No. 1 only using drywells or deep trenches. ,
2. That the drywash on Lot 11 not be obstructed. i
3. Subsurface drainage and foundation design should foTlow the recommenda-
tions of the Lincoln-Devore report.
