�, WHEREAS, the Aspen Skiing Company feels that the distribution of skiers

�_ on Aspen Mountain is at present uneven, and

� WHEREAS, they wish to increase utilization of the Lift 1-A side of the

:: Mountain and Lifts 7-A and 8 are not served by a restaurant facility, and ;

�• WHEREAS, the lacation is on relatively steep slopes and an area of some i

��. �:�r? instability, and �

�=c:; WHEREAS, the Board considered the scenic quality impacts and determined j

that since the Mountain is used commercially, a restaurant visible from town t
. '
. ,�'� but carefully planned to include site design aspects that will mitigate the �
� �:'s"_ 1
�x�'� visual impacts wou7d be acceptable, and

�,•'° WHEREAS, new commercial development in the County has an attendant housing

`i - provision requirement as per Section Z-15.2 of the Pitkin County Land Use ;
Code, and �
��' WHEREAS, the proposal is for a two-level building with a total area of s
_ �..., �
��� t
slightly over 9,000 sq. ft. and an additional 2,500 sq, ft. of decks, with
',
,
�,� some of the first 7eve1 be]ow-grade, and ;
- WHEREAS, an empioyee dormitory unit is proposed as part of the building
. -y�� for security purposes and to meet the housing requirement, and
WHEREAS, the Aspen/Pitkin Environmental Health Department has expressed
several concerns upon which the approval will be conditioned, and
WHEREAS, the Aspen Skiing Company has agreed to provide a sewer line to
the building and the Aspen Metropolitan Sanitation District has agreed to
accept the waste generated by the faci7ity, and
WHEREAS, a public hearing was held on May 10, 1982, and continued until
May 13 and May 17> 1982, at which this application was discussed.
NOW, TNEREFORE, BE IT RESOLVED by the Board that Special Review approval
is granted for the construction of Ruthie's Restaurant and an employee unit as
propased with the following conditions:

� � 1. Detailed construction plans be submitted to and approved by the

��s_: 2. Complete and finalized restaurant plans be submitted to the Aspen/Pitkin
':�. Environmental Health Department for approval.

,�•--' 3. The following provisions concerning the water supply: ?

3� A. Sufficient water storage tank with proper vents to prevent back �
_��"' flow, which will satisfy the Land Use Code requirements for fire
' flow and maximum daily use.
� B. A chlorinator to maintain the minimum residual of .2 parts per 4
�.
million free available chlorine in water at the tap. ��
�; C. Filtration in the form of in-line cannister filters to remove rust
and loose fragments generated from the lines and tank.
D. Proper disinfection procedures must be instituted on all supply
'*� lines and the storage tank prior to placing them in service for
the water system. Verification and monitoring will be performed
�' by Environmental Health.

4. That sewer lines will be constructed to hook the restaurant into the
Aspen Metro Sanitation District.
5. Incineration allowed only if there is no visual impact and the air
quality impacts are minimal. Installation must conform to all direct
�,: �. source air contaminant regulations of the State of Colorado as contained
�i in Regulation 3 of the Colorado Air Pollution Control Cortmission. -

6. Encourage the use of conservation devices, namely 2-qt. flush toilets, :�
;�` metered basin valves, dishwashing equipment with lower water demands, ;�
{,, and trash compactors. �;.�

�`: 7. The employee housing requirement may be met by the provision of E�
"' housing for seven employees either on-site or off-site. '? `

"' 8. This Special Review Approval applies only to winter use in the daytime �
;: hours coincidental to the hours of the ski area operation. �
