=u WHEREAS, the Board of County Commissioners has met with the Planning

� Office in numerous work sess�ons to discuss the data gathered in the Growth

�k4 Management Pian update and to consider the imp7ications of this information �
upon the existing growth management regulations, and
�
WHEREAS, the Aitkin County Planning Commission met on March 2, March 16,
� March 30 and April 20, 1982 to review the Growth Management Plan and the
�;
`•'3 regulations implementing the Plan and did recommend to the Board of County `
�. �i �
�; Commissioners that various procedural and substantive amendments to Sections
��;

� 5-510 and 5-300 of the Land Use Code be adopted, and
, ��
��c.K WHEREAS, the Board of County Commissioners has concluded that on the
i•;
' e�:� basis of the data presented by the Planning Office and on the experience of
;s�
, the Planning Commission in scoring applications for growth management allocations
:�
�; that it is necessary to make various procedural and substantive amendments to
Sections 5-510 and 5-300 of the Land llse Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado that Title II, Section 5-510 of the Land Use Code be
repealed and reenacted to read as follows:
5-510 Growth Management Quota System

5-510.1 Limitations on Development -';`,
(a) From and after the effective date hereof, there shall be issued, �;.�..
in each year, building permits within Pitkin County for no more thah :'?

(1) within the Aspen Metro Area (excluding the City of Aspen): 33 �'�- '

(2) within the Down ValTey Area (excluding the Crystal River Valley ��k
and frying Pan areas): 24 residential dwelling units. i'?-;� .

(b) The Aspen Metro Area shall be considered to consist of the Red/ -
Smuggler Mountain, Roaring Fork East and Buttemilk/Owl/Maroon/Castle ;;;i
growth management areas, as these are defined in the Aspen/Pitkin '�'"�
County Growth Management Policy Plan (Third Draft). The Down Valley '�:
Area shall be considered to consist of the Starwood/Woody Creek, Brush '':t'�'
t�;.
Creek, Snowmass/Capitol Creek, Gerbazdale, Snowmass Canyon and Sopris/ ;•���
Emma/Basalt/Wingo growth management areas, as these are defined in the �'�

` The following development activity shall be exempted from compliance
��a, with the limitations and requirements of Section 5-510.5. �

t'�{i (a) The remodeling, restoration or reconstruction of any existing
''-ii building, provided there is created no additional dwelling units
";= {except if constructed pursuant to Section 5-510.2(b)).
�`�'; {b) The construction of one single-family or duplex structure on a lot ((
#:� subdivided prior to the effective date of this regulation. I.'��
; �,
a`� (c) The construction of a single-family home on a lot formed by a lot �
{:.
�=�,�, split as defined in Section 4-6.

�y� (d) All housing units (under resale or rental controls) constructed
�;� within the Permanent Moderate Housing (P.M.H.) Zone Category (established
�<� pursuant to Resolution No. 76-112 of the Board of County Commissioners
i� of Pitkin County); and all rental housing units constructed on the :
�;r= same site as a commercial use, and restricted to occupancy by persons
�;��' (and their families) employed by the commercial use, and further
_��; restricted by maximum rentals falling within the low or moderate
�F; rental guidelines established pursuant to Section 5-510.5(a}(2)(D).

;:- (e) All construction pursuant to valid building permits issued prior
i� to the effective date of this regulation.

(f) All development not limited by the provisions of Section 5-510.1(a). ;

- (g) Any unit approved pursuant to Section 3-8.13.

�-" (h) The replacement of a single-family residence, provided, that this
� �� exemption shall be limited to residences legally established and used
` ;'; exclusively for permanent residential purposes and shall not exempt
, iy� compliance with requirements of Section 7-1.12.
�`y Provided that the Building Inspector shall, as required by Section 5- ,
'�"{:� 510.6(b), annually report the development activity exempted by reason
of Section 5-510.2{b), (c), (d), (e), and (g) and these totals shall
;} } be deducted from the quota of allowable development in succeeding
years.
�r' 5-510.3 Excess Allotments

(�± (a) In awarding allotments in any given year the Board of County Com-
� missioners may authorize construction in excess of the maximum number
of dwelling units specified in Section 5-510.1(a) by as much as twenty
,f percent of the quota established; provided, however, that any such :
" excess shall be offset by a corresponding reduction in allotments `'�
�:
4-i given in successive years such that every fifth year the total construction
within the previous five years shall not be in excess of the cumulative
total prescribed by Section 5-510.1(a).
(b) The Board of County Commissioners may (but need not), upon the �3
demonstration that the oroposed project is not otherwise economically �
feasible because of required on-site or off-site improvements, grant a �
� development allotment for an entire project to be constructed over a �;.
period of years provided that each year during the scheduled construction ¢�,:~
the annual allotment (provided for in Section 5-510.1(a)) shall be ``
reduced by the amount of construction permitted by the approval. ��'� � .

(c) The Board of County Commissioners may (but need not), permit the ;
construction of essential governmental projects and housing units !.
constructed within the Permanent Moderate Housing (P.M.H.) Zone Category �
without these being deducted from the quota of allowable development 4
in succeeding years. In the event that the Board shall consider the �
granting of such an exemption from the quota system, it shall require �
that the Planning Office evaluate the limitations on development in �
Pitkin County and report to the B�ard on the need for revisions to '�
these limitations which would take effect during the subsequent year. �

± (d) If in any growth management area {described in Section 5-510.1(a))

allotments in such growth management area, it being the intention of -
�,� this section that at no time shall the competition for development
allotments be entirely precluded by reason of build-out on previously
�R subdivided lots and the development of employee housing units. Any

� 5-510.4 General Provisions
��-�
��n (a) For the purposes of this regulation there shall be included within
�" the definition of residential dwelling units any single-family, duplex
�N or multi-family structures as well as mobile homes. No new mobile
home space shall be established, nor a mobile home located and/or
?� occupied within Pitkin County (except within a space in an established �';
+`G and approved mobile home park), unless and until an allotment therefore
shall have been obtained as provided for herein.

� (b) The Planning Office shall reject any application for a development
'�` allotment which fails to comply with the minimum requirements of the
� Pitkin County Land Use Code; provided, however, that if the development
�, shall require a special review, zoning, subdivision, P.U.D., or other
discretionary approval, application for such approval shall be processed
'� simultaneously with an application for a development allotment and �
:j`, r' failure to have procured such approvals prior to filing an application �
� herein shall not be grounds for rejecting said application.

(c) Not more than one application for any development site shall be
, � considered in any one year.

, �v,, (d) Any development needing special review, subdivision, P.U.D. or
rezoning approval which has received a development allotment shall be
�� deemed to have satisfied the provisions of Section 6-3.4(c) of the �;:,
;�.
- � Pitkin County Land Use Code, and the applicant may proceed to public
'� �' hearing before the Board of County Commissioners. Applications failing ��-
_ to receive any allotment shall be deemed finally denied and processed
• no further under the provisions of said Land Use Code.
(e) No project shall receive final subdivision, special review or
rezoning approval until the applicant shall have been awarded a development
� allotment whenever an allotment is required for the proposed development.
' (f) Development allotments shall not be assignable or transferable
independently of the transfer of the real property on which the approved
project was proposed to be constructed. Any successor in interest on -
land for which an allotment has been awarded shall be subject to the
same terms and conditions under which the allotment was granted.
(g) In the event that two projects have received identical point �=-
totals and one may be approved only to the exclusion of the other �_�
because of insufficient allotments bein9 available, the two applications ^'`�
shall be reconsidered and points reassigned until the tie is broken "��
and the project receiving the higher total awarded an allotment. Es�; '

(h) The award of a development allotment for any land shall not prevent �_„�
Pitkin County from considering and approving a rezoning application or
other amendment to the Land Use Code (or other land use regulation of �
the County) or taking other action inconsistent with the allotment;
it being understood that the award of an allotment alone shall not
constitute a vested right in the development proposed nor be considered
sufficient to bar later inconsistent legislative or administrative �':
actions by Pitkin County.

(i) The Planning and Zoning Cortenission will annually review (and when '.i
necessary, initiate changes to) the Aspen/Pitkin County Growth Manage-
ment Policy Plan and this regulation, which review shall include, at a
minimum, holding one public hearing (with notice of the same published
at least once in a newspaper of general circulation within Pitkin ;;�

�:� 5-510.5 Residential Development Application

(a) No residential development shall occur within Pitkin County,
��3`� except within the Crystal Ualley and Frying Pan areas, unless exempted
f� pursuant to Section 5-510.2 herein, until the proposed development
�� shall have received an allotment pursuant to the following procedures: ,
:�� '
p.� (1) All applicants for residential development allotments shall
�°y�, file with the County Planning Office, on or before June lst of each
` year, a completed application which shall be submitted with the
i_�+�,"+ following maps, documents and information:
;� (A) All submission contents required for General Submissions
'�"� specified in Section 6-3.2, et seq., of the Pitkin County Land
�-��' . Use Code.

,;. (B) A written description of the proposed development including
�-�� comrtients as to each of the following (to the extent not apparent
z4� from the materials submitted pursuant to the requirements of
�^,�,� Section 5-510.5(a)(1)(A) above):

� �`�" (i) Type of water system to be used, including information on

, �� availability of water and, if a public supply, the excess
��� capacity available from such system; the distance to connect
''' �`" to the nearest main; and the estimated water demand of the
proposed project. In the case of unused water rights, any
�� proposal to convey the unused water rights to the public .
;� entity providing water. In the case of land which has been
�' historically irrigated, the quantity of water which will
continue to be available for the purposes of irrigation and
the identification of all historically irrigated lands on the
property.
(ii) Type of sewage treatment system to be used and, if
public, the existing excess capacity available from such
public system; the distance from the building site to the
nearest trunk or connecting sewer; the expected demand of the
development or building.
(iii) Type of drainage system proposed to handle surface,
underground and runoff waters.

(2) The Planning Office shall evaluate all development a])otment :;
applications during the months of June and July, reject those that ;3. .
are ineligibTe under Section 5-510.4(b) and present its recommendations �-
to the Pitkin County Planning and Zoning Commission no later than �
August lst of each year or the Corrmission's first regular meeting
subsequent to that date. The Planning and Zoning Commission shall ��'=:-;
review all applications taking into consideration the following K�•: •
criteria and point schedule with respect to each of the fol7owing y'�:,
areas of concern. �
(A) Availability of public and private facilities and services ;
(maximum 24 points). The Commission shall consider each application ,y
with respect to its impact upon public facilities and services ;:;
and shall rate each development by assigning points according to � ,

;'� irrigation purposes, whenever appropriate. If a private
�"� system, considering the capacity and reliability of the
;� system being proposed and the demonstration of water rights
F�' to serve the development and to attain any necessary water

;; (ii) Sewer (maximum 3 points) considering the ability of the .
':� sewer system to serve the development, and if a public system, -
� ;�; the applicant's commitment to finance any system extensions �

~� of the system being proposed.

' �""� (iii) Storm drainage (maximum 3 points) considering the

' ability of the appropriate Fire Protection District to provide
fire protection according to the established response standards

Road Master P1an. Considering the applicant's commitment to �;�
finance necessary road system improvements attributable to js •

fourteen (14) days of the action of the Planning and Zoning Commission �

5-510.6 Rescinded and Expired Permits

�r (a) All applicants who shall have been awarded allotments shall submit
� plans sufficient for building permit issuance within a period ending on
�� the second anniversary of the deadline for submission of the application
for which the allotment was awarded and must then proceed with construction
�F; with diligence; and fai1ure to do so will cause the allotment to auto-
�;,� matically expire. (However, in the event the applicant shall have
: y received approval for a subdivison of land only and proposes to offer t
--' e�� lots for sale for development by individual owners, he need only (to
;�* satisfy this provision} record his plat with the Pitkin County Clerk and

(b} Should an applicant awarded a development allotment substantially
deviate from any element of his proposal, or fail to satisfy a material
condition imposed on the allotment received, or fail to comply with the
phasing schedule submitted with his application, the Board of County
Commissioners may, after hearing, rescind all or any part of the allotment.
In the event of re�ission, the app7icant shall be prohibited from filing
an application for another allotment for a period of one year from the
date of recission. Any rescinded ailotment may be added to ava97able
allotments and awarded in the next year, at the discretion of the Board
of County Comnissioners, upon the recommendation of the Planning and
Zonir�g Consnission. -

5-300.3 Conditions for Waiver �,
The housing requirements of this Section 5-300 shall be waived for resi- �

of land only once and upon further subdivision of either lot full compliance
with the housing requirements established in Section 5-300 shall be met. �

5-300.4 Satisfaction of Requirement
�;. ` (a) The proponent of a development will be deemed to have satisfied
" the requirements of this Section 5-300 if he shall, on the site of
�;, ; the proposed development or on an alternative site, comply with one �
