r} WHEREAS, Roger A. Simmons and Constance J. Simmons (hereinafter referred

to as "Applicant") are the owners of record of Lot 2, Block 2, Gateway of

��; Snowmass Mesa Subdivision, lst Filing, and

;�� WHEREAS, in June, 1980, the Applicant applied for Special Review approval �

�'i for an employee dwelling unit pursuant to Section 3-8.13 of the Pitkin County

�� Land Use Code, and

�; WHEREAS, a public hearing was held before the Board of County Commissioners

z „� at their regular meeting on May 10, 1982 at which time evidence and testimony

'--:; were presented with respect to the application.

�`; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of

` f_� Pitkin County, Colorado, that it does hereby grant Special Review approval for

�''' an employee dwelling unit on Lot 2, Block 2, Gateway of Snowmass Mesa Subdivision,

'� �.� lst Filing, subject to the following conditions:
� l. After the current tenant vacates the unit, all subsequent tenants
�' `' shall meet the low income classifications established by the Pitkin
�•
County Housing Authority, and
�'

�ci 2. Subsequent owners of the subject property shall be allowed to rent
� the employee dwelling unit only to persons meeting the Pitkin County
� Housin9 Authority income guidelines at such rental rates as may be
��'� established by the Housing Authority from time to time, and
', 3. The current rental rate shall be adjusted to reflect allowable rent t�� .
;�_� per the guidelines in effect at the time of approval, and
� 4. The Applicant shall agree to support and join any improvement dis- `
�'=
� tricts which might be formed in the future or currently exists in .
the area. -
