WHEREAS, the City of Aspen is in the process of obtaining a grant of ± �;'�� e:� easement and rights of way from Art Pfister, more specifically described in �",_ ! r� Exhibit A attached hereto and incorporated herein by reference, and � �.;y , +Y� � Y.' �:-� WHEREAS, the City of Aspen is in the process of obtaining a grant of �,'" x„� easement and rights of way from the Aspen Grove Cemetary Association, more (_:� %k specifically described in Exhibit B attached hereto and incorporated herein },� ,... i'� by reference, and , µ"� WHEREAS, the Board of County Commissioners, at their regularly scheduled � � �f ; �^� meeting on July 26, 1982 did consider applications by the City of Aspen for i z:v + G:� subdivision exett�tions for the purpose of constructing water tanks on the : �.� - ' ��' Pfister and Aspen Grove properties, and �;.g �.,. �-� WHEREAS, the Board did consider the relationship of the proposed tanks ':a � . t '�-'}� to the 7ong range water system plans of the City of Aspen, including those �.� . 9 indicated in the Water Management Plan and the Capital Improvements Program 't �� � ;`� associated with the water bonds approved by the City's voters, and _ � `, � WHEREAS, the Board finds that because of the following evidence presented � �� to it,that the proposed water tanks help to meet the quality needs of the 1�. �.'_ ➢=y: water system rather than providing additional capacity for new users because: � � 1) The purpose of the tanks is to create redundancy in the water system ; re:• � so that reliable backup facilities are available in the case of a ;}. , �_K. a treatment plant or water main outage and to meet basic firefighting � � ` needs of existing development east and west of Aspen. � 2) The tanks will bring the water system up to the American Water Works �. . �;�,'s: Association minimum standard of a l:l ratio between water treatment :�''• ,., and treated water storage capacity so that at least 24 hours of - :_.� consumption capacity is available in storage, and therefore represent ;:� a system up9rade and not a system extension, and � • WHEREAS, the Board finds that the proposed water tanks do not qualify °`v3 ;,�"' as system extensiqnsand therefore do not fall within the purview of 1041 ,.�... The applicant will submit a detailed landscaping plan to the County ��. �t `� engineer for each tank, including a proposed schedule for landscaping ; : and grading and a performance bond before the subdivision plats �- � �. are accepted for recordation by the County Clerk; • �'� c,� �i 5.
