�� WHEREAS, a public hearing was held on the 22nd day of November,

,�` ';;:; 1982 wherein it was apparent that the proposed site is located in a

,.-:, rural area of continuing agricultural operations and is convenic�nt

�3 and accessible to Basalt Sanitation District; and

_ �4•� WHEREAS, the applicant has submitted such technical information

�'�: as required by the Colorado Department of Health and the Aspen/Pitkin
•� �F` County Environmental Health Department and received recommendations

`t - of approval from both departments; and
��'� WHEREAS, the Basalt Sanitation District and the property owner
�':' of the proposed sludge disposal site, Emil Grange, have entered

��� into and agreement, which is incorporated hereto by reference,

�! setting forth specific mutual promises and agreements for access, :� .
��
operations, sampling, and record keeping; and
�� WHEREAS, the sludqe disposal methods proposed could be highly

beneficial as fertilizer to the agricultural land in question, and �.
�& could permit the recycling and reutilization of nutrients. Both �

of these are consistent with the policies of Pitkin County and �``":

WHEREAS, the proposed program o£ land application of sludge, �
unless meticulously and carefully managed, could potentially cause �
problems with odors, insect breeding, and/or surface or groundwater � •
pollution; and �

the Board of Commissioners absent the imposition of such conditions

and incorporation into the soil; and should cause to be made such

�� NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners

y� of Pitkin County, Colorado, as follows: � .

1. Grant of Certificate of Designation. The installation and �
� use of the proposed sludge disposal site by the applicant is hereby .
?•i certified, pursuant to Section 30-20-105 C.R.S. 1973, as amended,

and the Board of County Commissioners hereby deems that a Certificate
�� r� of Designation (attached hereto) shall be granted to the applicant. � �

�� Said certification is subject to temporary suspension or revocation ".

'��� as provided by Section 30-20-112 C.R.S. 1973, and this Resolution,
, �� i£ after proper reasonable notice and public hearing before the Board

of County Commissioners evidence is presented that the representations �

of Basalt Sanitation District that the installation will have no •��•
•' - significant adverse impacts are, in practice, incorrect or that
,
�-
the site and facility fails to comply with all applicable laws,
resolutions and ordinances. No other solid waste other than stabilized
��'� sewage sludge shall be disposed of as this site.
2. Agreement of the District. The Basalt Sanitation District
's`;
�
' shall by resolution unconditionally agree to and accept the provisions
�:
��-:� of this Resolution and shall not commence operations of the sludge ;;
disposal facility until the attached agreement or a similar resolution �`�
;� is returned to the County, approved by the Countiy Attorney as being ;�.,;
ra�;�
consistent herewith, and made a part of the record herein. Upon ^���:

receipt and approval aforesaid, such Agreement shall constitute and
° be enforceable as an inter-governmental contact by the Basalt ;F
Sanitation District and Pitkin County. �
3. Safety and Monitoring Program. The Basalt Sanitation u '

District shall install such soil, ground water, runoff and surface „�
water, and odor monitoring facilities as the County, acting through �
the Aspen/Pitkin County Environmental Health Department, shall, from �

�- stability of applied sludge is such as to meet the objective criteria

� Grange:

�;_ a) Sludge stability and quality shall meet all the criteria �,
� established in Parts V and VI of the Technical Policy of the State
� of Colorado Department of Health Guidelines for Slud e Utilization � ,
�� '
on Land. The Basalt Sanitation District shall perform quarterly,
�� or as often as applied,an analyses of sludge composite samples to
determine the following parameters: Percent Total SoTids, Percent
�� Volatile Solids, pH, Volatile Acids, ammonium nitrogen, nitrate
�' �` nitrogen, organic nitrogen, total nitrogen, total phosphorus, total �
� potassium, conductivity, total arsenic, polychlorinated biphenyls,
;i;,'• total cadium, total chromium, total copper, total lead, total
} mercury, total nickel, total selenium, total zinc, stability and
�
•�t volatile solids reduction or oxygen uptake rate. If after the
�.
" first year, it is determined that certain parameters are consistently
{' 'i�
z
- present in trace amounts or altogether absent from the stabilized
sewage sludge, the requirement for monitoring these may be waived 'c
��� by the Aspen/Pitkin County Environmental Health Office.
��
b) Soils shall be sampled yearly by a representative soil
;;,
E.� sample from at least five locations within the site where sludge has
�>:
�t been applied. The sample shall be analyzed for pH; extractable
� cadmium, copper, lead, nickel, zinc and cation exchange capacity.

In addition, soils must also be analyzed yearly for organic content �;:
i�
t of soil, nitrogen content in regard to ammonium and total content, �,'

potassium content and phosphorous content by agreement with the

land owner.

c) The Basalt Sanitation District will undertake the �

monitoring of any and all wells within 1/4 mile of any boundary of ;e

the sludge disposal site prior to the application of any sludge ;; �
and quarterly thereafter. These wells should be tested for total `�
�
coliforms and total nitrogen. �;

d) The County shall have the ability to collect its own ';
:'�
samples for analysis as necessary.

Sanitation District shall be forwarded to the Aspen/Pitkin County
� Environmental Health Department every June and December until such

Y� 4. Required Performance Standards. The installation shall �• '�

.s not be operated except in accordance with the following standards: `

t; a) Odor, offensive to persons of normal sensibility and
� attributable to sewage sludge, shall not be discernable beyond the
�� property boundaries of Grange tracts.
+�� b) Surface runoff from the sludge disposal site, including �" '
�:
�� runoff from extraordinary storm or moisture situations arising from �
'�i
� the Home Supply Ditch, shall be diverted around the site to natural
"' d i a
r��.� ra n ge channels. Flood irrigation to the site shall be prohibited
;' for twenty-four (24) hours after sludge application and any irrigation ;
' �� ditch leaks shall be reported to the Aspen/Pitkin County Environmental
�.
� Health Department immediately. � .
.,� c} No loud or offensive noise exceeding the maximum �
i::
:�. permissible levels in Colorado Noise Abatement Article (Title 25,
' �;� Article 12, C.R.S. 1973) shall radiate beyond twenty five (25)
�'
7r.r� feet of any property lines of the Grange Tracts. �' `

d) No contaminates, chemicals or micro-organisms, 4c�'

potentially harmful in nature, shall be introduced into ground or

surface waters. Should contamination in levels exceeding recommended

t. public health standards be monitored in wells or surface waters �_

adjacent to the site the applicants shall upon notice cease operations -

F, and at the expense of the Basalt Sanitation District cause to be
� installed any and all devices or take any and all corrective ;;� .

_ measures on the property of private owners as shall be necessary :<`

ti� to correct or prevent the same, insofar as such contamination shall �'
have been proximately caused by the applicants operations.

e) The site shall be made reasonably secure from �°•;� •::

unauthorized entry and appropriate measures shall be taken to obstruct j

the access to unauthorized persons. «
��f) No solid waste other than soil cover materials and
stabilized sewage sludge shall be disposed of on the site. �

g) The Basalt Sanitation shall maintain records of the �
number of trips and volume of sludge disposed on the site. �

h) No expansion or modification of the use of the i
designated sludge disposal site shall occur without the review ��

tlimited to maximum loading rates specified for the five year period
�� by the Colorado Department of Health Guidelines for Sludqe Utilization

� k) The liquid sludge shall be incorporated into all fields
� except those producing alfalfa by disking or covering with soil
within one week of application.,
� 1) Sludge shall not be applied during precipitation
• :i • events, on water-ponded or saturated land, or on pasture land
�; �
� unless livestock is excluded from grazing for a period of two weeks.
`�-E 5. Violations and Hearings. Any person aggrieved by a failure
by the applicant to comply with the terms and conditions hereof
� � shall have standing to enforce this Resolution by lawful litigation �'
'�'� or administrative proceedings. In the event the County determines
i' that probable cause exists to believe that the applicant is not
i
acting in compliance herewith, the County may initiate prodecures
� as required by law to require the applicant to cease operations. F
At a public hearing theBoard of County Commissioners shall review f`
the actual and proposed management practices for the site and the �' .
� , f
requirements of this Resolution. The public shall be given an :
opportunity to object to the continued operation of the site if the ' �
same is causing adverse impacts upon adjacent lands. At the �
�:
conclusion of such a hearinq, if substantial evidence warrants �'

action, the Board of Commissioners may amend the foregoing `�t�''•-'`

certification and continue it in effect with additional conditions �`'.�.�' .,:'-:

for the protection of the public or adjacent lands; or upon a finding ;'

The Basalt Sanitation District, upon revocation shall terminate
operations within a reasonable period of time not to exceed fourteen �
(14) days.
6. Records and Amendments. The service plan, maps, hearing
