CONCERNING THE LAND TJSE APPROVALS ANb DEVELOPMENT ,

R ECITALS

L The protection of the tenants and owners of deed restricted housing at the
W/J Ranch has,and remains,the Board of County Commissioners'primary goal.Despite '
allegations and assertions of inconsistencies,this goal has never changed. �
2. The W/J Subdivision Exemption process was expedited consistent with
' County policy for affordable housing and to avoid threatened eviction and/or rent �

increases to previous tenants of the W/J Ranch.
3. The Board of County Commissioners continues to seek to expedite
- so[utions to the housing problems that confront our community. �

4. The County thoroughly and completely reviewed those legal and technical !
issues,raised by the Woody Creek Caucus and its consultants,regarding past zoning and
land use actions by the Board of County Commissioners ihcluding:BOCC minutes;staff
memorandums;applicant submittals;public comment;and,county records.
5. The Board of County Commissioners finds no reason to take fiuther action
regarding prior approvals concerning the W/J Ranch with tl�e exception of enforcement of
all of the conditions and requirements of those approvals. ' •

1. The Board of County Commissioners will initiate a master planning

process concerning the W/J Ranch and sunounding community to determine what '
,•'.',;,
number and type of deed restricted housing is appropriate for development on the Ranch.
This determination will be based upon analysis and discussion of such issues as
compatibility with surrounding land uses; establishment of appropriate buffer zones "=r•�`
between residential and other legally established uses in the community, and broader - •
community housing needs,environmental,and gowth goals and policies.

2. Following the master planning effort, the Boazd intends to establish
zoning which would prohibit any development other than that which is consistent with "

the resulting master plan.
3. The Boazd of County Commissioners will initiate the Master Plan and I!

rezoning of W/J Ranch as soon as possible,and in conjunction with the Woody Creek ':

Caucus Master Plan process recently initiated. �;F:-7'`

4. The Board of County Commissioners intends to hold W/J Ranch, Inc.
tesponsible for all past representations made to the Boazd and to the homeowners by its ;
officers and representatives during past approval processes and for all conditions imposed
by the Boazd as part of past development approvals. Such representations include,but aze �
not necessarily limited to those regarding: road improvements; sales price restrictions; 1

loan terms; healtU and safety improvements such as UBC compliance, adequate water
, .
supply for fire protection purposes, legal septic systems, electric service and telephone
systems. �
5. The Board of County Commissioners will assist the owners of deed �

restricted properties to the fullest extent possible in dealin�with septic problems at the j
