RECITALS
� 1. Fabienne Benedict{hereafter"AppiicanP')has applied to the Pitkin County Board of '
County Commissioners(hereafter"Board")for consideration of aa extension of vested real
property rights pursuant to Section 4]40-30 of the Land Use Code.
2. Pursuant to Resolution 92-424,the App]icants received an atlocation for one single
. famiiy residence in the County's non-metro area Growth Management Competition.
i 3. Pursuant to Resolution 92-42�,ihe applicant received General Submission,1041 Hazard
� Review,Scenic Over(ay and a Subdivisian Exemption approval by Board.

_ j 4. The subdivision exemption allowed for the creation of a 10 acre scenic parcel which was
f
subsequently conveyed to Pazk Trust Ltd.
s 5. A GMQS Exemption and Special Review approval were granted for one affordable
housing unit on-site.
6. The subject property is located on the south side of Hunker Creek,near the entrance to the
Hunter Creek Valley,more specifically described in Exhibit"A"
7. The Board considered the request at its regalarly scheduled meeting of 7anuary 10,1996,
at which time evidence and testimony were presented with respect to this applicacion.

5. The Board determined that the proposed development meets the criteria established in

Section 4-140.30 of the Land Use Code,and,therefore,found the extension to be appropriate. ,y

NOW,THEREFORE,BE IT RESOL'VED by the Pitkin County Board of County

Commissioners that it dces hereby grant an extension to the vesting period for the Benedict G

Hunter Creek property until November 16,1998,subject to compliance with the following �

conditions of approval and the conditions of Board of County Commissioners Resolution No.92- ,y .

420(attached as Exhibit"B.") ��
�
1. The applicant shall comp]y with the foilowing standards for development on slopes of �
greater than 15%; �,} -
A. Adequate mechanicat support shall be provided for cut siopes.
B. Adding water which may decrease slope stability shali be avaided. �
C. Adding weight to the top of the slope shall be avoided. �
" D. Disturbed slopes must be contoured so that they can be revegetated.
E. Steepening of existing slopes shall be avoided.
F. Confine cuts,�lls,grading and excavation to the minimum uea needed far
construction.
2. The applicant shall compty with the foliowing landscaping and wild�re defensible space
• mitigation standards:(This condition shali supercede condition No.2,Resolution No.92-
420)
A. Brush,debris,and non-ornamentaf vegetation shall be removed within a miaimum
10 foot perimeter azound the structure,
B. Vegetation shall be reduced ro break up the verticai and horizontal continuity of the
ifuels a minimum of 80 feet on the downhill side of the residence and up to 50 feet
� on ihe sides and upslope side of the residence.
� C. Spacing between clumps of brush and vegetation within the perimeter noted above
shall be a minimum of two times the height of the fuel. Maximum diameter of the
clumps shatt not exceed 10 feet. All measurements sha11 be from the edges of the
crowns of the fueL ,
' D. Al]branches from trees and brush within the perimeter noted above shall be pruned
to a height of 10 feet above the gronnd and ladder fuels from around trees and brush
shall be removed.
E. Tree crown separation within the perimeter no[ed above shalf have a minimum of 10
feet between the edges of the crowns.
' F. All branches which extend over the roof eaves shall be trimmed and all branches ��'
� within 15 feet of t6e chimneys shall be removed. --

3. The applicant shall comply with the following additional wildfire mitigation standards:
A. Roof constntction shail be Class A,non-comlwstible matezia]with no flat roofs. 6
B. Vents shall be screened with carrosive resistant wire mesh with mesh�/a inch �

C. Roofs and gutters shal[be kept cleaz of debris. ?
D. Yazds shall be kept c(ear of all litter,siash,and flammable debris. � ` '

F. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not T

G. Firewood/wood piles shall be stacked on a para(lel contour a minimum of 15 feet ca
away from the structure.
H. Swimming pools shal)be accessib1e to Fire Department vehicles. o
I. Fences shall be kept clear of brush and debris.

. J. Wood fences shall not connect to the structure.
K. Any outbuildings or additional structures sha11 adhere to the same standards as
structures.
L. Fuel tanks shall be installed underground with an approved container.
M. Propane tanks shall be installed according to NFPA 48 standards and on a contour

, any above-ground tank. Any wood enclosure around the tank sha11 be constructed
with materials approved for 2 hour fire-resistive construction on the exterior side of
the walls.
N. Each structure shall have a minimum of one]0 pound appmved ABC fire
extinguisher placed in a visible and accessible location.
O. Addresses shall be clearly marked with 2 inch non-combustible letters and shatl be
' visible and instalied on a non-combustible post.
P. Utility lines shati be buried.

4. Prior to issuance of a building permit,the applicant shall submit a landscaping plan to the
Land Management and Planning Departments for review and approval. Land
Management may require financial security to ensure that the landscaping is successfully . ,
completed within one year after completion of construction of the residence. The
Landscape Plan shall address revegetation of disturbed construction areas and access
road improvements. The Plan shall identify exterior IighGng,specify revegetation
techniques,plant materials and performance standards. Lighting shall comply with
County lighiing standards itt efPect at the time of building permit appiication. (This
condition shall supercede condition No. 14,Resolution No.92-420.) -_

as otherwise modified in the other conditions outlined in this resolution.
8. Residential floor area shall be limited to 8,500 square feet as calculated pursuant to the
Pitkin County Land Use Code. The categoty one deed restricted dwelling unit shall contain ; �
at Ieast the minimum net liveable floor area for such a unit established in the Aspen/Pitkin
Housing Guidelines in effect at the time of issuance of a building pertnit.
9. The applicant shall adhere to aii material representations made in pnbiic hearings and in the -
application.
