1. Charles and Barbara Oys and Sallie Pickus(hereafter"Applicants")have applied to the '
Pitkin County Board of County Commissioners(hereafter"Boazd")for approval to construct a '
single-family residence and accessory structure.
2. The property is]ocated on the north side of West Sopris Creek Road,and is more
specifically described in Exhibit"A",attached. �

3. The property contains 7.48 acres and is zoned RS-30.
i 4. This application was reviewed by the Planning and Zoning Commission(hereafter
� "Commissiod')at a regular meeting on November 7,1995,and a recommendation of denial was �.j

? forwarded to the Board. '
5. The Board heard this application at its regularly scheduled meeting of February 14,1996,at
i which time evidence and testimony were presented with respect to this application.

� 6. The Board found that development of the Subject property is prohibited,pursuant to 5ection � �
� 3-80.70(A)(3)of the Land Use Code,which prohibits development in areas identified by the
� Colorado State Forest Service as containing severe wildfire hazard.
' NOW TEIEREFORE BE IT RFSOLVED by the Pitkin County Board of County , �
