RECITALS -
1. Judy Haas(hereafter"Applicant")has applied to the Pitkin County Board of County
Commissioners(he�eafter"Board")for consideration of an amendment to the 1041 Hazard Review
ito relocate the approved building envelope to include an existing cabin and Rural/Remote Special

Review approval to establish setbacks,to install a septic system,to extend utilities,and to allow a

1,000 square foot footprint for the principal structure.
; 2. The property is located at 88 I.ower Hurricane Road,and is more specifically described in

� Exhibit"A",attached. �
3. The property contains 8.43 acres and is zoned Rural/Remote.
4. The property is within a mapped potentiai avalanche area and contains slopes in excess of
30%a
5. This application was reviewed by the Hearing Officer at a duly noticed public hearing on

j January 25,1996. The Hearing Officer continued the public hearing on this application to the
i
� Board because the Hearing Officer is not authorized to make a determination with regard to Special
' Review uses in the RurallRemote zone district. "
6. The Board heard this application at its regularly scheduled meeting of February 14,1996,at

� A. The existing cabin is not located in an avalanche hazard azea.
B. The location of the proposed building envelope is an improvement over the]ocation u:�;3,:
of the approved envelope with regard to avalanche hazard. '

D. The building envelope as amended by staff complies with the requirements of the '

E. The proposed special review uses are consistent with the intent of the Rural/Remote
zone district and the character of the surrounding area.

following condidons:

1. The applicant shall record an amended 1041 Hazard Review site plan,prior to submission i
� of any building permit applications. All conditions of approval shall be noted on the site
plan. The site plan shalf be amended as follows:
• Slopes of greater than 30%shall be excluded from the building envelope.
• The building envelope shall not be]azger than 1/2 acre. �
• The front yacd setback shall be 2D feet and the side yard setbacks shall be at least 30 F
- feet.

2. Prior to issuance of a septic permit,the applicants shai!provide documentation to the i
Environmental Health Depar[ment as to the location of the well and the quantity/qualiry of
the water.
3. The applicant shall provide documentation to the Environmental Health Depar[ment as to
the type of outhouse. If the system is illegal,it must be removed and the applicant shall `.
obtain a permit from Envimnmental Health for an approved system.
4. A septic peanit shall be obtained from the Environmental Health Department,prior to
issuance of a building permit for any addition to the existing cabin or a new residence. � ���-,

5. A fireplace/woodstove permit shall be approved by the Environmenta(Health Department �
prior to issuance of a building permit for a new residence.

6. The Applicant shall comply with the following standards for development on slopes in
excess of 15%,pursuant to Land Use Code Section 3-80.50(C): �.`�

A. Adequate mechanical support shall be provided for cut slopes. '°;'r.� �
B. Adding water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided - '
D. Disturbed slopes shall be contoured so they can be revegetated. •
E. Steepening of existing slopes shall be avoided.
F. Confine cuts,fills,grading and excavation to the minimum area needed for
construction. '
7. Site specific soils engineering studies and proper soils engineering techniques shall be ;'�
utilized to insure correct foundation design. Foundation plans shall be certifed by a ;4r
Colorado registered st�uctural engineer and shall be provided at building permit applica[ion. ��
Subsurface water shall be directed away from the foundation.
• 8. A three foot bemt shall be constructed to the southeast of the residence to protect it from
' potential snow or mud flows.
9. No development or disturbance of any living native vegetation shall occur outside of the ',�.k
approved building emelope. :i
. i 10. The building footprint of the new residence shall not exceed 1,000 square feet.
11. The approximately 350 square foot existing cabin shall be deed restricted to Resident ti
Occupied,prior to issuance of a building permit for the new residence. The cabin shall be
required to be rented by the owner to a qualified employee in Pitkin County,who meets the
qualifications as defined in the 1995 Aspen/Pitkin County Affordable Housing Guidelines.
12. The existing cabin shall not be expanded.
13. The applicant shall adhere ro all material representations made in the application or in �
public meetings. '
