Charles and Barbara Oys and Sallie Pickus(hereafter"Applicants")have applied to the • � Pitkin County$oard of County Commissioners(hereafter"Board")for Conceptual Submission � � approval to coostruct a single-family residence and accessory structure. � I 2. The property is located on the notth side of West Sopris Creek Road,and is more ' � - , specifically described in Exhibit"A",attached. 3. The property contains 7.48 acres and is zoned RS-30. 4, The property is impacted by the following hazards �, N� • Mapped mule deer winter range and winter concentration area; � • Mapped elk winter range,severe winter range,critical habitat and winter concentration azeas; . Severe wildfire hazard; ,' • Slopes of greater than t 5%; • Potential rockfall hazard;and ; { • Drainage guUies. i5. This application was reviewed by the Planning and Zoning Commission(hereafter i "Commission")at a regulaz meeting on Novem6er 7,1995,and a recommendation of denial was forwarded to the$oard. " 6. The Board found that development of the subject property is prohibited,pursuant to Section ��i.. 3-80.70(A)(3)of the Land Use Code,which prohibits development in areas identified by the : �.� Colorado State Forest Service as containing severe wildfire hazard. The Board voted unanimously to deny the application as evidenced by Resolution No.96�attached as Exhibit"B". 8. Pursuant ro Section 4150 of the Iand Use Code,the applicants requested a hearing to ' determine whether the Board's denial of the application constitutes a taking of private property . • , wi[hout just compensation. 9. The Boazd conducted its takings hearing on February 28,1996,at which time further evidence and testimony was presented concerning the taking. 10. The Board Finds that the previous denial dces constitute a taking of all reasonab(e use and ; economic retum from the subject property,since there are no developable azeas on the subject property outside of confirmed severe wildfire hazard areas. 11. The Board finds that the property is not appropriate for any use other than residential,and k. , the Board does not wish to purchase the property. 12. The Board finds that this application proposes development in the best possible location, given the hazards identified on the property. NOW THEREFORE BE IT RESOLVED by the Pitkin Conaty Boazd of County s Commissioners that it does hereby rescind Resolution No.96� � BE IT FiJRTHER RESOLVED by the Board that it does hereby grant approval to the Oys/Pickus Conceptua]Submission,subject to the foliowing conditions: � 1. The applicant shall record a 1041 Hazard Review Site Plan,prior to submission of any building permit applications. The site plan shail be modified as follows: A. Brush,debris,and non-omamental vegetation shall be removed within a minimum • 10 foot perimeter around the structures. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structures. 4� C. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall �� be a minimum of two times the height of the fue). Maximum diameter of the j�' clumps shall not exceed 10 feet. Ail measurements shall be from the edges of the _ crowns of the fuel. � D. All branches from trees and brush within the 30 foot perimeter shall be pruned Yo a height of lU feet above the ground and ladder fuels from around trees and brush I' shall be removed. ;.�, E. Tree crown separation within the 30 foot perimeters shall have a minimum of]0 `{� feet between the edges of the crowns. � F. The density of fuels within a 100 foot perimeter of the structures shall be reduced. H. All deadfall within the 100 foot perimeter shall be removed. I. The applicant shall be responsible for the continued maintenance of the defensible space vegetation reqvirements. 6. The applicant shall comply with the following additional wildfire mitigation standards: �" A. Roof construction shall be Class A,non-combustible material with no flat roofs. '� B. Vents shall be screened with conosive resistant wire mesh with mesh�/a inch j • maximun. C. Roofs and gutters shall be kept cleaz of debris. The Applicant shall comply with the foilowing standards for development on slopes in excess of IS%: A. Adequate mechanical support shall be provided for cut slopes. � B. Adding water which may decrease slope stability shall be avoided. C. Adding weight to the top of the slope sha11 be avoided. D. DisCUrbed slopes shall be contoured so they can be revegetated. ,:- E. Steepening of existing slopes shall be avoided. �J, ' F. Confine cuts,fills,grading and excavation to the minimum area needed for construction. 8. The applicant shall adhere to the Uniform Building Code specifications for Seismic Zone II. 9. Site specific soils engineering smdies and proper soils engineering techniques sha]]be � � utilized to insure correct foundation design. Foundation plans shall be certified by a Colorado registered structural engineer and shall be provided at building permit application. 10. The gully through the building envelope shall be re-routed and enhanced to conduct drainage to the east of the residence. The drainage swale shalt be at least 3 feet deep and 8 feet wide,and shall extend at least 8 feet downhill from the proposed residence.
