RECITALS .
1. 7erome Webster,hereafter"Applicant",bas applied to the Boazd of County Commissioners
of Pitkin County,Colorado,hereafter"Board",for approval of a cazetaker dwelling unit pursuant to

Section 3-150.130(B)of the Land Use Code.
2. The Applicant's lot is zoned AFR-10 and is approximately 3.827 acres in size.
. 3. Said parcel is located at 0558 Johnson Drive;Tract R-40,Starwood Four.
, 4. The Applicant proposes to deed restrict an existing detached art studio as a caretaker
. dwelling anit pursuant to Section 3-150.I30(B)of t6e I.and Use Code. �
_ 5. The Boazd heazd this application at a regularly scheduled meeting on April 14,1996,at
� which time evidence and testimony was presented with respect to the application.
� 6. The Board finds that the proposed caretaker unit complies with the criteria established in
j Sections 3-150.130(B)and 3-210 of the Land Use Code.
� 7. The Board also finds that tfie current owner intends to use the unit as an art studio,and

agreed to accommodate this use by not requiring the owner to install kitche�facilities until such
time as the unit is utilized as a caretaker dwelling u�it. '
NOW,THEREFORE,BE IT RESOLVED by tha Board that it does hereby grant
' approval to the Webster Caretaker Dweping Unit application subjeci to the following conditions:

1. Prior to issuance of a building permit,the applicant shall record a caretaker dwelling unit •
deed restriction with the Housing Office. The deed restriction shall include a condition that ,.`+.,.
a kitchen is not required to be insta(led in the unit until a tenant is qualified through the
Housing Office to lease the unit.
2. The caretaker dwelling unit shall be limited to 7D0 square feet of net livable azea.
;
3. The applicant shall provide a letter of intent to serve from the Starwood Water District,
prior ro issuance of any building permits. _
4. A septic permit shali be approved by the Environmental Health Department prior to
building permit issuance,unless it is determined by the Environmental Health Deparcment
that the existing system is adequate to service the unit.
5. The Applicant shall adhere to all material representations made in the public hearing and in °
the application.
