THIS AGItEEMENT, made and entered into this day of

'�. ASPEN, C ORADO, a municipal corporation (hereinafter referred to i

as "City") and the BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, j
COLORADO (hereinafter referred to as "County"). �

,�,� F� WHEREAS, the County desires to utilize the services of the !

City Animal Warden and his or her deputies; and �

WHEREAS, the City and County are both concerned with animal �

control and education; and �

�'•: WHEREAS, the County is also concerned with the protection of i
� 3 .
''�, wildlife and livestoek in the County; and "

i� :;, WHEREAS, the County and City desire to enter into this agree- �
� �
ment for the establishment, funding and operation of a Joint Ani- �
mal Control Department and Program, �
NOW, THEREFORE, BE IT RESOLVED that:
7) The County agrees to send 1/12 of its share of the
annual joint budget £or the Animal Control Program, a copy of
- which is attached hereto, to the City monthly. The City agrees to
remit to the County 1/2 of the program's monthly revenues on a
monthly basis. Permission for the City to exceed the set budget
must be granted prior to any commitment or expenditure. The final
budget for the 1983 operating year must be approved by both the
City and the County prior to December 15, 1982, and may not be
reduced in dollar amount subsequent thereto, except by mutual
agreement by both parties.

� 2) The City Manager will be responsible for operations of '

the Animal Control Program, and all employees are to be under his
or her. authority.

�.•:' 3) The Animal Control Program will allocate its time

��`.` equally between the City and County, as far as is practicable.

�i� Wildlife problems will be referred whenever possible to the State

��-� Wildlife Control Officer, and the City will attempt to obtain �

�= reports from the Wildlife Control Officer on County activities `:
��� during the previous month.

� 4) The City will provide the County with monthly reports
'^''. showing departmental revenues and expenditures, time spent in the '
County and the City, number of trips to outlying areas in the
�• � County, number oi dogs picked up in the City and in the County,

i�, and the number of wildlife/livestock activities during the month.

5) License fees, pound fees, and other charges wi11 be as

�:r may be determined from time to time by resolution of the Board of

a; County Commissioners and the City Council.

, �=� 6) This agreement is in accord with the attached joint

budget, hereby adopted, and will expire upon the expiration of the

�;k calendar year 1982.

� ^w 7) Administration of the finances for this department shall
,, be handled by the City Finance Office at no additional expense or
;.r charge to the County.
� 8) On or before March 15, 1983, a final settlement of
;
revenues and expenditures for the program shall be completed and a
reimbursement of all final payments settled and transacted. �
