COLORADO, hereinafter called the "County". � W I T N E S S E T H: �a WHEREAS, the growth and needs of the City of Aspen and the County of �` '� PItkin in the 1960's and early 1970's demonstrate the need for excellence in � City and County research and planning, and r -��, WHEREAS, both the City and County recognize that it is dysfunctional to � restrict such research and planning to jurisdiction lines and that a mutual � governmental planning effort will facilitate clear communication and efficient •� � planning productivity and that duplication of such services by the City and �` '� County could only result in costly duplication of efforts, and WHEREAS, it is the desire of both parties to continue to improve the � joint City/County Planning Office (hereinafter "Planning Office") and to share ;i ;� in the management and expenses of that Planning Office, pursuant to the statu- tory authorization concerning intergovernmental contract Section 29-1-203, �; 5 " C.R.S. 1973, House Bill 1034 (1974) and Section 13.5, City of Aspen Home Rule ��, ° �' ' - r: Charter. ':�� NOW, THEREFORE, THE CITY AND COUNTY AGREE A5 FOLLOWS: '" , � : �^.:. � A. PLANNING OFFICE RESPONSIBILITIES: " 1. That the Planning Office shall be responsible for: - �:,F.':� _•;.:: a. Research, including the maintenance of a data bank, library, �'•:: land use and housing inventory, population data, etc. ;� { '.=;c, b. The administration of the zoning ordinance of the City. r c. The administration of the subdivision regulations of ��' the City. � i:� d. Administration ��'� shall be distinguished from Code enforcement, which is the � ;' �� charge of the City/County Building Inspector. � ' 5�' n%' 3; e. The administration of HUD 701 planning assistance, State += of Colorado 1041 land use administration funds, and Federal � Environmental Protection Agency 208 planning assistance funds, and such other State and Federal planning programs as may from time to time become available. �� f. In conjunction with the Planning and Zoning Comnissions, '�. .. � the development and maintenance of the official Compre- •- hensive Plan(s) for both the City and County, including � such elements as transportation, land use, public facilities, social and economic concerns, environmental protection, and goals for development. In addition, the office of the Planning Director shall serve to advise the Planning and f� Zoning Commissions of both the City and County. This '� advice shall serve as a technical support function with the y`� understanding that the office of the Planning Director ��, +� reserves the right to advise the City Council and the � . Board of County Conanissioners separately and apart from the . recommendations of respective planning and zoning commissions. ;?. �; g. Recortanendations to the City Manager and County Manager '�c� concerning the presentation and maintenance of a Capital � Improvement Budget and five (5) year capital improvement program for both the City and County. r: �. h. In conjunction with any Downtown Commission of the City � ,�� of Aspen, the presentation and maintenance of ongoing �'•, (� plans for the physical development of the central area • �� of the City of Aspen. :� i. In conjuncti• with the citizen cau�uses of the County, F`-: � the satisfaction of their planning needs, and the integration thereof, if feasible, into the Comprehensive Plan and the �! � work program of the County, provided that the Planning Director shall review the work involved in the satisfaction ` of such needs and reserves the right to schedule such work as time permits. ! \ j. Comnunication between the City and County of matters of physical development which are of mutual concern to both `� � parties. Such other responsibilities as may from time to �i_ time be assigned by either the appropriate P&Z or the City � Council or the Board of County Commissioners. This shall ;;, include the organization of joint City/County clearinghouse meetings, A-95 reviews for both parties, and environmental ` impacts statement review. ��=�'° N•:,•��,'�:�. k. PIANNING OFFICE ADMINISTRATION AND PERSONNEL +i �: .. 1. The Planning Office shall be headed by a Planning �irector, � ' who shall be jointly appointed by and serve at the pleasure and only with the concurrence of both the City Council and the Board of County Commissioners. The Planning Director shall � receive compensation as agreed to by the City Manager and the �;� County Manager and within the Planning Office budget approved ' .� by the City and County, and shall be considered a City employee for payro]] and benefit purposes. ! �` � Z. The Pianning Director sfiall manage the Pianning Office, including � ; personnel, operating policy, and P7anning Office responsibilities � + � as outlined in this agreement, with the understanding that the � P]anning Director may recruit, dismiss and continue to emp]oy .�,.y personnel in conformance with the personnel policies of the City of Aspen and with the joint advice and consent of the City � � Manager and the County Manager. � ;..` 3. With respect to those services, responsibilities and duties to � � be performed exclusively for the City, the Planning Director and � employees of the Planning Office shalt be accountable to and '` '; subject to the supervision of the City Manager. With respect - to those services, responsibilities and duties to be performed exclusively for the County, the Planning Office shall be responsi- � ble to and subject to the supervision of the County Manager. �. � C. PLANNING OFFICE BUDGET ( The City and County adopted and approved for the 1983 calendar and �, budget year the budget revenue comnitment from said City and County i attached hereto as Exhibit "A". D. PLANNING OFFICE PRIORITIES � 1. The Ptanning Director and personnel shall,insofar as practicable, � devote Planning Office time and monies between the planning functions of the City and County as depicted in the attached � program and expenditure budget for 1983. 4 2. All work allocations among planning personnel, including "ex- �-',:;:�.° clusive" City or County work, shall be the responsibility of -- " the Planning Director. �,::: : 3. The Planning Director shall certify as to the distribution of �; office time in the form of bi-monthiy time sheets which shall verify the actual employee time effort expended on specific programs. This information may be summarized in periodic ;.� reports submitted to the City Manager and the County Manager. _� i 4. All accounting, payroll and audit services for the Planning , Office shall be performed by the Finance Department of the City ��` . u�• of Aspen. - �%'�'� � , ��V, 2. Costs that can be directly attributed to the City shall be �' y�; charged to the City and those directly attributed to the County charged to the County. ��,,�.`. M�7 �. 3. Revenues that can be directly attributed to the City shall be credited to the City and those directly attributed to the �i County credited to the County. ,�� t'n+`-,': 4. Costs and revenues that cannot be attributed to either the City � or County shall be charged or credited to each entity in the �*�,, proportion that the entity's direct costs bear to the total �e: direct costs. 5. The County shall pay to the City monthly one-twelfth of its �:..,; share of the attached 1983 budget. Revisions to the budget must �;; be approved at a joint meeting of the City Council and Board of >,� County Coimnissioners. �, �� ' �''��_�'�� 6. On or before March 15, 1984, the actual net cost of the Planning �Yf Office to the City and County shall be determined by the City :'��;1 and County Finance Directors and P7anning Director, and the `i� final reimbursement shall be settled and transacted. r,.,�: r:'t . �.r F. ANNUAL RENEWAL AND TERMINATION ';'t;', ��'. 1. This agreement shall be amended, renewed and adopted annually at �r.? the time of the official adoption of the budgets of the City and - ��'•_ County and if not amended, revised and adopted, shall lapse and - < be terminated at the end of the calendar year for which it is +� �?��° effective and the Planning Office shall cease to exist. �L:; �� ;�- 2.
