Board of County Commissioners of Pit[tin County, Colorado, hereinafter "Boazd", for � *

approval of a Special Review Use Permit for legalizaUon of 5 existing residenrial dwellings, x+'�

peimitted ovtdoor recreational uses,and the limited use of the existing lodge.structure as a ''�'?

� recreational building accessory to the pemutted recreational uses,pursuant to Section 3-20 '
' of the Land Use Code. �•
2. The site is zoned AFR-10 and is approximately 54 acres in size. ��''�u

3. Said site is located 12 miles south of Aspen,between Castle Creek and Castle Creek
Road,more specifically described in Exhibit A,attached. �3.
, 4. A site plan of the properiy is attached as Exhibit"B".
5. "I'he Planning and Zoning Commission recommended approval of the Special
Review Use Permit at the Mazch 7,1995 regulaz meeting.
6. The Board heazd this application at scheduled meetings on June 28,August 8,and � •

September 5, 1995, and on May 22, 1996, at which time evidence and testimony was �
presented with respect to tivs application. �

7. The Board finds that the proposed outdoor recreational uses and the associated use
..{.
of the Lodge structure do not constitute a second p�incipal use of the subject property and
that the proposal meets the criteria established in Section 3-20 of the Land Use Code.
8. The Boazd finds that the current development proposal for the subject property, �''' �
including both Allowed and Special Review Uses,represents a total maximiun development '
level for this property. Expansions to Residential, Lodge, or Recreational use of the
property will require an amendment to this Special Review. �
NOW,THEREFORE,BE IT RESOLVED by the Boazd that it does hereby grant
a five(5)year Special Review Use Permit for the Elk Mountain Lodge property, subject to the
' ' following conditions:
. 1. The Applicant annually submit a statement which demonstrates the continued conformance
� of the use to the condidons of the Special Use Permit to the Community Development
� Director. If, after reviewing the statement, inspecting the site and considering any other �
relevant materials, the Director determines that the use is not in conformance with the
� provisions of the Special Use Pemut, the Community Development Director shall
recommend to the Board that it consider withdrawal of such permit,pursuant to a duly
noticed public hearing.The statement shall be annually submitted to the Planning O�ce 45
� days prior to the anniversary of approval by the Boazd of County Commissioners.

i 2. Any significant change to any of the residential structures,lodge,or permitted recreational
� uses shall require an amendment to this Special Review Use Permit,shall constitute a new
i
iapplication,and shall require a repetition of the procedures described in Section 3-20 of the
Code. Minor changes to the use may be authorized by the Planning Director without
additional public review[Section 3-20(E)(2)].
3. The appropriate deed restrictions shall be filed with the Housing Office for Cabins A,C- •
east,and C-west,prior to the issuance of a Certificate of Occupancy for the lodge structure,
as follows:
1) Cabin A shall be deed restricted to Resident Occupied(RO)status. .
2) Cabin C-east shall be deed restricted as a Category 2 Affordable Housing Unit. �^.'-

3) Cabin C-west shall be deed restricted as a Caretaker Dwelling Unit. " -
4. T'he Applicant shall request that the Chief Building Official inspect the Lodge Structure,
Cabin "C"-west, Cabin "C"-east, Cabin"D", Cabin "E"-west, and Cabin "E"-east for
compliance with the Uniform Building Code within 30 days of Board of County
Commissioners approval. ��r� �
5. T'he Applicant shall complete any struchual or safety improvements to the lodge structure '
required by the Chief Building Official,prior to the issuance of a certificate of occupancy • '
for the Lodge structure. !
}
6. The Applicant must submit documentation of a sufficient quantity and qualiry of domestic
water to serve the proposed uses to the Environmenta!Health Department,prior to issuance
of a Cedificate of Occupancy for the lodge structure.
7. Prior to the issuance of a certificate of occupancy for the lodge structure,the Applicant shall .
. submit documentation to the Environmental Health Department which indicates the
location of all existing and abandoned septic systems. The Applicant shall satisfy the
Environmental Health Department as to the adequacy of the septic system for the proposed
uses,prior to the issuance of a C.O.for d�e lodge structure.The Applicant is required to
have the caterer and/or event coordinator execute a Use Agreement prior to each event
which includes,but is not limited to,the requirement that dishes shall not be washed on the �'
_ premises.The water usage for each event shall be metered and logged and provided to the.
EHD on a monthly basis.Water usage shall not exceed the capacity of the septic system as
determined by the EHD.
8. The Applicant shall submit a fireplace/woodstove permit, if any additional fixtures aze
planned,to the Environmental Health Department,prior to the issuance of a Certificate of
Occupancy for the lodge structure.
9. The Applicant shall obtain a Food Service License from the Environmental Health
Department,prior to the issuance of a Certificate of Occupancy for the lodge structure
• 10. The Applicant shall submit a PM10 Mitigation Plan to the Environmental Health
Department for approval,which is consistent with the life of the Special Use Permit,prior •
to the issuance of a Certificate of Occupancy for the lodge structure.
11. The Applicant shall remove the kitchen of the lower dwelling unit in Cabin"D",prior to
inspection by the Building Department. •

12. Not more than 35 vehicles,not including residenYs vehic]es,shal!be allowed to park on �'.�,-,-�
the Elk Mountain Lodge property at any time.Violation of this provision will constitute a � . •.
violation of the Special Use Permit and shall be grounds for the revocation of said permit. `�
13. Parking on Castle Creek Road right-of-way shall be prohibited. The American Lake -
trailhead pazking azea shall not be utilized by residents or guests of the Elk Mountain Lodge
property. ';� '
14. The Applicant shall provide documentation or other reasonable evidence of the approximate ' '
age and past use of Cabin E"-east and Cabin'B"-west to the Historic Preservation Officer �
for a detemvnation on 8ie histodc value of said cabins,prior to the issuance of a certificate �'
of occupancy for the Lodge structure. t
15. There shall 6e no ovemight lodging or camping permitted for any event on the Elk
Mountain Lodge property.

16, Commercial snowmobile and motorcycle operations are prohibited on the Elk Mountain F
- Lodge property.
17, The number of commercial events allowed,pursuant to this Special Review iJse Permit,
shall be limited to 52 per year and be limited to no more tharz 3 events per week.

I8. The number of people on the property per event shall be limited to 250,including event �
• staff.

i 19. The Applicant shall pay Pitkin County a pro rata share of the actual constructed
improvements to Maroon Casde/Highway 82 intersection which is consistent with the life
of the Special Use Permit.Pro rata share payments shall be made ai the time of the annual
review of the Special Use Permit,provided actual improvements have been made in the �
preceding year.
20. The Applicant shall adhere to all material representations made in the application and in the
public meetings,unless otherwise amended by other conditions.
21. The existing"free-markeY'single family residences may not be expanded unless approval is
granted by Pitkin County after consideration of the impacts associated with expansion and '
the"carrying capacity ofthe property".
22. The Applicant shall be required to cancel events scheduled or proposed during periods of
high or extreme avalanche danger,or when an avalanche warning has been issued. The °
Applicant shatl comply with this requirement based on informarion provided by the Couniy
